【摘要】 随着资本主义现代工业的不断发展,出现了种类丰富、功能繁多的产品,为人们的生活提供方便和舒适。同时,由于科技发展的不可预测性和产品生产、流通中的缺漏,出现了大量缺陷产品导致他人人身和财产遭受损害的案件。自1842年英国“温特博汤诉赖特案”首次出现产品责任问题至今,产品责任损害赔偿问题日益受到各国重视,各国纷纷从保护相对弱势的消费者角度出发,制定了相应的产品责任损害赔偿的法律。我国在改革开放以后,市场经济的快速发展过程中不可避免的发生了各种各样的产品责任事故,涉及到的损害赔偿案件层出不穷,然而由于我国法律体制的不健全,目前的损害赔偿制度已经难以满足人们当前的需要。本文从阐释产品责任损害赔偿的概念出发,分析我国产品责任损害赔偿制度的现状与缺陷,同时借鉴国外各国先进立法和司法经验,探索如何完善我国的产品责任损害赔偿制度和建立我国的产品责任惩罚性损害赔偿制度。希望通过完善我国的产品责任损害赔偿制度使消费者的权益能够得到更进一步的保护,强化我国企业的质量管理和危机意识,预防因产品责任而引发的损害事故。本文除引言和结束语外,包括四大部分。第一部分概述了产品责任损害赔偿的一般理论,包括产品责任损害赔偿概念分析、产品责任损害法律关系主体和产品责任损害赔偿的范围;第二部分针对我国的实际情况,分析了我国的产品责任损害赔偿的现状和存在的各种缺陷,主要包括:产品责任人身伤害赔偿数额不合理,产品责任损害赔偿制度功能不全面,产品责任损害赔偿立法体系不协调和产品责任损害赔偿制度构建不完善;第三部分通过介绍世界各国的先进立法经验,提出如何完善我国的产品责任损害赔偿制度,包括完善我国的立法体系,完善产品责任人身损害赔偿范围、金额以及完善产品责任精神损害赔偿;第四部分主要探讨如何建立我国产品责任惩罚性赔偿制度,分析建立我国惩罚性损害赔偿制度的价值、功能、必要性,在借鉴各国的法律实践的基础上,对建立我国产品责任惩罚性损害赔偿提出一些建议。更多还原

【Abstract】 With the continuous development of modern industrial capitalism, the emergence of species-rich, functional range of products for people’s lives to provide convenience and comfort. At the same time, due to the unpredictability of technological development and product production and circulation in the gaps, there has been a large number of defective products causing personal and property damage cases. Since 1842 the United Kingdom, "Wen Thebaud Tang v. Wright case" since the first time in product liability, product liability damages, has attracted increasing national attention, countries have relatively weak protection of consumers from the perspective, to develop the corresponding product liability damages law. After China’s reform and opening up the market’s rapid economic development during the inevitable occurrence of a wide variety of product liability accidents, involving an endless stream of cases of damages, but because of our legal system is not complete, the current system has been damage difficult to meet people’s immediate needs.This paper illustrates the concept of product liability damages, analyzes the damages, our product liability system status and defects, while reference to foreign countries in the advanced legislative and judicial experience, and explore how to improve China’s product liability damages system and the establishment of China’s product liability punitive damages compensation system. Hope that by improving our system of product liability for damages to the interests of consumers can be protected further strengthen our corporate quality management and a sense of crisis to prevent product liability due to damage caused the accident.In addition to this introduction and concluding remarks, included four major sections. The first section provides an overview of product liability in the general theory of damages, including product liability damages, conceptual analysis, product liability damage to the relationship between the subject and the product liability law damages coverage; the second part of the actual situation of our country, analyzed the damage to our country’s product liability compensation status and the existence of various defects, including: product liability unreasonable amount of compensation for personal injury, product liability damages system function is not a comprehensive legislative system for product liability damages for product liability damages, uncoordinated, and inadequate to build the system; Article the three parts of the advanced countries of the world by introducing the legislative experience and put forward how to improve our system of product liability damages, including improving China’s legislative system, improve the scope of product liability personal injury compensation, amount and improve the product liability compensation for moral damage; fourth part of the main to explore how to build China’s product liability punitive compensation system, analysis of punitive damages have established our system of values, function, necessity, drawing on national legal practice, based on the establishment of China’s product liability punitive damages in some suggestions.更多还原
