【摘要】 监狱是国家刑罚执行机关,肩负着监禁刑执行的历史使命。我国监狱工作方针是:惩罚与改造相结合,以改造人为宗旨。把罪犯改造成为守法公民,是监狱工作的终极目标和价值追求。但近年来,刑满释放人员重新犯罪问题日趋严重,重新犯罪率呈波浪上升态势。而且,重新犯罪以其手段高明、情节复杂、危害严重及强烈的反社会性,对社会的安全稳定造成很大威胁。重新犯罪是一个复杂的社会问题,除了社会环境、家庭生活等客观因素,监狱改造工作难度大、改造质量不高是导致重新犯罪的首要因素。如何提高改造质量,降低重新犯罪率,是监狱机关面临的关键问题。仔细研究现行的以劳动改造为主的监狱监管模式,还存在诸多需要认真反思的硬伤,这些硬伤直接影响了改造质量的提高,构建科学合理的监狱监管模式,已成为监狱工作迫切之需要。本文以监禁刑执行社会效果为视角,以对西北某监狱调查研究的资料为实例,通过对我国建国以来各个时期的监狱监管模式比较研究、分析总结,最后提出笔者认为可行的监管模式,以期通过该模式能够提高改造质量,降低重新犯罪率。本文除了引言和结语,共有四个部分:第一部分:监禁刑的执行情况及社会效果。第二部分:新中国监狱监管模式的确立及发展。第三部分:现阶段我国监狱监管模式存在的问题、原因分析及对策。第四部分:康复医院+特殊学校监管模式构建。综上所述,全文在通过对各时期监管模式比较分析的基础上,提出适合我国国情的监狱监管模式。笔者希望这次写作尝试能对现实有些意义。更多还原

【Abstract】 Prison is national executive organ of penalty, which shoulders the historic mission of performing imprisonment. The guideline of prison work in China is combining the punishment with the transformation. To transform the criminals into the citizens abiding the law is the pursuit of value and ultimate goal of prison work. However, in recent years, the re-crime of the reintegrating released prisons has been rising. Furthermore, the re-crime threatens the security and stability of society greatly by various methods of offense, serious plot, severe damage and intense anti-sociality.Re-crime is a complex social problem. In addition to the objective factors such as social environment and family life, the primal causes are the difficulty and poor quality of transformation to prisoners. Therefore, how to improve the quality of transformation and reduce the re-crime are the critical problems setting in front of the organization of prison. After the carful investigation to the present management modes in prison which have been based on labor-transformation, we find there are a lot of problems needing careful reflection which influenced directly the quality of transformation. It is urgent to construct the scientific and reasonable supervisory modes in prison. Taking the research materials as examples, the thesis compares and analyzes the modes of imprisonment at different stages since the found of People’s Republic of China from the perspective of social effects of imprisonment, and finally the writer puts forward the practical supervisory modes with the aim to improve the quality of transformation and reduce the re-crime.In addition to the introduction and conclusion, there are four parts in the thesis. In the first chapter, the writer introduces the executive situation and social effects of imprisonment. Chapter two reviews the establishment and development of supervisory modes in prison. Chapter three shows the problems on present supervisory modes in prison, analyzes the causes and puts forward the countermeasures. Chapter four is about the construction of supervisory modes by combining the rehabilitation hospital with the special school.All in all, the writer expects that this attempt will have the practical significance to the present supervisory modes in prison.更多还原
