【摘要】 随着城镇化进程的逐步深入,农村宅基地的经济价值日益凸显并备受关注。作为我国物权法中一种特殊的用益物权,农村宅基地使用权是关系中国亿万农民切身利益的一项基础性权利。作为农村宅基地使用权诸项制度的前提,取得制度至为关键。然而,现行立法中有关农村宅基地使用权取得制度的法律条文数量过少,内容简单,可操作性不强。因此,加强对农村宅基地使用权取得制度的研究,为这一制度今后的进一步完善提供理论支持,具有极为重要的意义。本文在引言部分介绍了写作的背景、方法和意义。第一章界定了农村宅基地、农村宅基地使用权及其创设继受取得的含义范围,介绍了作为本文论证平台和出发点的三大基本原则：尊重法律法理,体现物权法的固有性；统筹兼顾保护农民的宅基地申请权、尊重农民集体土地所有权、便于国家土地行政管理；尊重和坚持村民自治,符合政治走向。农村宅基地使用权之概念、性质和权利特征界定地准确与否直接决定着对农村宅基地使用权取得制度进行分析与研究的准确性、深刻性。第二章对农村宅基地使用权的性质、概念和法律特征进行了分析,是第三章、第四章的理论基础和铺垫。主体制度是农村宅基地使用权创设继受取得制度的重要环节,第三章对农村宅基地使用权的设定主体和取得主体进行了分析与界定。第三章论述了出让主体是村农民集体,而不是村集体经济组织或村民委员会；取得主体是农民个体,而不是农户。第四章首先介绍了农村宅基地使用权创设继受取得现行立法模式的内容,进而对现行立法模式进行了宏观解读和微观分析,之后就是否应该修改和如何完善进行了探讨与分析。结语部分对本文的观点进行了梳理和总结。更多还原

【Abstract】 As the rapid development of urbanization process, the economic value of rural house sites has been paid more and more attention. The right to use house sites, as a special usufructuary right, is directly concerned with the practical interests of billions of farmers. The rules for acquiring the right to use house sites is the key issue because it is the premise of other relating systems. However, the corresponding provisions in the current legislation are scarce, macroscopic and unpractical. As a result, it is important to strengthen the study about this acquiring system.The preface introduces the background, methods and significance of producing this paper. In the first chapter, the author on the one hand ascertains three concepts: rural house sites, the right to use house sites and the original acquisition of the right to use house sites, on the other hand establishes three study principals:respecting the current legislation, theories and the Chinese traditional real rights characteristics; giving overall considerations into the following three aims:protecting villagers’ right to apply house site, respecting the ownership on collective lands, the convenience for administrative regulation; respecting villagers self-governance in order to accord with the political trend. Those principals are the foundation and platform for the following research.The study accuracy about the concept, the legal nature and legal traits of the right to use house sites directly determines the profundity about acquiring the right to use house sites. So, the second chapter gives a deeper analyze about the concept,the legal nature and legal traits of the right to use house sites which lays a foundation for the discussion in the third and fourth chapter.The subject system is an important part of acquiring the right to use house sites. The third charter makes clear the setting right subject and the acquiring right subject. The setting subject shall be the village peasant collectives, not the village collective economic organizations or village committees; the acquiring subject shall be individual villager, not the rural households.The fourth chapter introduces the content of the current acquiring pattern, then gives both macroscopic and microscopic analyze to this acquiring pattern.
