【摘要】 人权作为一个社会历史的范畴,是指在一定的历史条件下作为社会的人按其本质和尊严享有或应该享有的基本权利。它包括经济、社会、文化权利与政治权利等。从总体上看,体育权利应归类于社会经济文化权利,是人权的具体表现。同时,它作为一个综合子权利系统而分别包括生存权、人身权、受教育权等权利。奥运体育权是体育权利中的一个重要分支。它主要包括公平竞争权、生命健康权、受教育权与形象权等权利。体育权利载入法律文件之中,在世界范围内只有几十年历史,是一项新兴的权利。奥运体育权属于体育权利的一种,对它的确认和保护,可以从国际体育法律文件与国际人权法律文件中找到有力表证。《奥林匹克宪章》、《体育运动国际宪章》等国际体育法律文件和《联合国宪章》、《世界人权宣言》、《公民权利与政治权利国际公约》与《经济、社会、文化权利国际公约》等国际人权法律文件间接地体现了对奥运体育权的法律保护。由于国际体育法律文件和国际人权法律文件的不完善,运动员的公平竞争权、生命健康权、受教育权及形象权等奥运体育权受到一定程度的侵害。特别是运动员中的弱势群体(包括妇女、儿童与残疾人)的奥运体育权也受到侵害。他们奥运体育权的法定权利没有得到很好的保障,所拥有的实然权利离应然权利有很大差距。如何有效地缓解运动员及运动员中的弱势群体在奥林匹克运动中所面临的以上种种问题,是国际社会面临的重大问题之一。要保障运动员与运动员中的弱势群体奥运体育权的实现,就必须完善国际体育法律文件及国际人权法律文件。同时,还应该加强各国法律法规的健全,加强非政府人权组织与国家之间的广泛合作。更多还原

【Abstract】 Hunan rights, within a social and historical category, refers to the basic rights enjoyed by the people of the society in accordance with their nature and dignity under certain historical conditions. They include economic, social and cultural rights, political rights and so on. Generally speaking, the sports right, which is a concrete manifestation of human rights, should be classified into social, economic and cultural rights. At the same time, as an integrated sub-systems, the sports rights include the right to live, personal right, educational right and so on. The Olympic sports rights, the significant branch of the sports rights, mainly include the right to fair competition, the right of life and health, educational right and the right of image and so on.There is only a few decades of history for Sports rights entering into the legal documents of the world, so the sports rights are burgeoning right. The Olympic sports rights, which belong to sports rights, are recognized and protected, with powerful evidence found from international sports legal documents and international human rights legal documents. "The Olympic Charter", "the International Charter on Physical Education and Sport" and other legal documents of international sports and the "Charter of the United Nations", "The Universal Declaration of Human Rights", " the International Covenant on Civil and Political Rights " and " and the International Covenant on Economic, Social and Cultural Rights " and other international human rights legal documents indirectly have reflected the power of the Olympic sports of legal protection. Because the international sports legal documents and international human rights legal documents are imperfect, athletes’Olympic sports rights, such as the fair competition right, the right of life and health, educational right and the right of image etc, have been damaged to a certain degree. Specially, the social vulnerable groups of athletes( such as women, children and the disabled), their Olympic sports rights are also encroached. Their legal Olympic sports rights are not well protected, so the rights they have are different from their due rights.It is one of the major problems for the international community to confront how to effectively ease these problems that the athletes and the vulnerable groups of athletes have faced in the Olympic Movement. To ensure the realization of the Olympic sports rights of athletes and social vulnerable groups groups of athletes, it is necessary to improve the international sports legal documents and international human rights legal documents. Meanwhile, we should also establish the national laws and regulations, strengthen a wide range of cooperation between non-governmental human rights organizations and countries.更多还原
