我国实施集体合同法律制度的理论与实践

On the Theory and Practice of Implementing the Group Contract Legal System in China

【摘要】 集体合同制度在西方是工会、国家和雇主之间长期充分博弈的结果,也是劳资双方在利益冲突中顺应历史潮流选择的妥协合作的权利方案。集体合同制度作为一项劳动法律制度,对保护劳动者合法权益在全世界范围内都起到了积极影响,发挥了重要作用。中国实施这项制度的时间还不长,真正在市场化经济体系中实行也是上个世纪末的事。从2008年1月1日起,随着《劳动合同法》的的正式实行,作为贯彻劳动法的一个最有效的核心制度,集体劳动合同制度在我国也越来越引起人们广泛而高度的重视。集体合同的推广实施,确实促进了我国劳工阶层的合法劳动权益的保障,但实施过程中出现的问题也足够引起我们的重视:一是大量的集体合同并未能真实反映劳动者的利益要求;二是大量的集体合同在履行过程中偏离了对劳动者的保护;三是还有很多劳动者特别是农民工由于不是工会会员而得不到集体合同制度的保护。造成这三个问题的主要原因在于:一、工会作用缺位;二、集体合同的订立过程中没有实现真正的劳资谈判;三、我国的集体谈判结构过于单一。本文通过中外集体合同制度的比较,从制度经济学和法学的角度对我国实施集体合同制度的现实困境,进行了较为详细的理论和实证分析,揭示了集体合同制度中若干权利安排的边界,以及权利划分的依据,并提出了改善和促进我国集体合同制度实施和发展的建议和措施。

【Abstract】 In the west, the Collective Contract system is a result that fully plays chess for a long time among trade union, country and employerAs , It is the right scheme that both sides of the labour and capital comply with compromise cooperation that chooses of the tide of history in the interests conflict too .as a labor legal system, the Collective Contract system has positive influences and plays an important role on protecting the legitimate rights and interests of laborers all over the world. The time that China implements this system is still not long, it is a thing at the end of last century too that really implement in the market-based economic system . From January 1, 2008, with formal implementation of " Labor law ", regard one effective key system most to carry out labour law as, the system of the collective labour contract causes people’s extensive . The popularization of the Collective Contract is implemented, has really promoted the guarantee of the legal work benefit of the stratum of labourer of our country, but implement enough : First, a large number of collective contracts can not reflect the request of the labourer’s interests truly; The second , a large number of collective contracts have deviated from the protection of the labourer in the course of fulfilling; The third , a lot of labourers especially rural workers can not make the protection of the Collective Contract system because they are not members of trade union . The main reason to cause these three questions lies in: First, function omission of trade union; Second, have not realized the real labour and capital to negotiate in conclusion of the Collective Contract; Third, the Collective Bargaining structure of our country is too single.By comparing Chinese and foreign Collective Contract, this paper performs theoretical and empirical analysis on the Collective Contract system in terms of System economics and Law in detail. Furthermore, the paper analyzes the realistic difficulties on implementing the Collective Contract system in our country, and reveals the margin of arrangement of some rights and the basis of division of some rights in the Collective Contract system, and then puts forward some proposals and measures to improve and promote the Collective Contract system in our country.
