【摘要】 与一般的农业的国内支持是指政府对国内生产的支持和保护规则,WTO第一次将各成员方农业政策、农产品贸易的国际协定纳入管理是1993年12月15日签订的《乌拉圭回合农业协议》,各成员方只能在WTO《农业协议》的法律框架之内制定农业支持和保护政策。从WTO老成员国的农业国内支持情况来看,对农业进行支持和保护是大多数国家的成功经验。而通过对“入世”前我国农业国内支持措施、“入世”时我国在农业国内支持问题上所做的承诺,和“入世”后我国主要实施的农业国内支持政策相比较,我国农业国内支持目前存在的主要问题有:一是国内支持政策作用过大,缺乏法律体系的构建;二是WTO农业协议条款利用不足;三是农业国内支持政策结构不合理,相关体系不配套;四是农业的可持续发展和农村发展政策不足。针对这些问题的解决构思是借鉴WTO老成员国的经验,构建我国农业国内支持国内法律体系。首先解决立法原则问题,改善我国农业国内支持法律环境;其次是建立与完善农业宏观调控体系,强化农业可持续发展和农村发展;最后是建立适应WTO农业协议的国内支持制度,强化政府服务,转变政府职能,完善支持农业发展的社会化服务体系。解决这些问题,需要我们以“法治”的思想和适应经济全球化特征的“国际调节”思想来共同应对。更多还原

【Abstract】 Domestic support for agriculture is the rules of Government’s domestic product support and protection . The "Uruguay Round Agreement on Agriculture" collect the agricultural policy, trade of agricultural products into the management of international agreements for the first time , signing in December 15, 1993.WTO members can only make the agricultural support and protection policy in the WTO "Agreement on Agriculture" of the legal framework.From the old agricultural domestic support of WTO member countries , agricultural support and protection for the majority of the country is successful experience. Comparing China’s agricultural domestic support measures before the adoption of WTO , with China’s domestic agricultural support commitments made on the issue when adopting in WTO, and with China’s major agricultural domestic support policies after the implementation ,the main problems of China’s agricultural domestic support currently are : First, the role of the domestic policy of support is too large, and it’s lack of legal system . Second, lack of using the WTO agricultural agreement . Third, policies’ structure to support domestic agriculture are irrational , the related system are not match with them . Fourth, the policies of sustainable development of agriculture and rural development are inadequate.The resolution of these issues , is to learn the idea from the old member countries of the WTO, and to build a domestic legal system of China’s agricultural domestic support . First of all, make the principle of legislation clear, improve China’s agricultural domestic support for the legal environment . This is followed by the establishment and improvement of agricultural macro-control system, to strengthen the sustainable development of agriculture and rural development . Finally, adapt to the establishment of the WTO Agriculture Agreement domestic support system, strengthen government services, transform government functions, improve agricultural development in support of the social service system .In general, to solve these problems, we need to "rule of law" and the idea to adapt to economic globalization, and be characterized by "international regulation of together to deal with it.更多还原
