赌博罪的若干问题研究

【摘要】 赌博是一种古老的社会现象,其危害性早以为人们所知晓,禁赌工作也就随之而行。在中国的历史上,历朝历代的统治者也都认识到了赌博行为严重的社会危害性,都采取了相应的禁止措施,但是赌博行为仍旧屡禁不止。目前,中国的禁赌工作也不容乐观,一方面,世界各国已经相继开始了赌博的非犯罪化进程,另一方面是不断蔓延的赌博态势,面对此种情形,我国的刑法将何去何从,这是很值得研究的问题。关于赌博应当犯罪化还是非犯罪化的问题,目前仍然存在很大的争议。笔者站在一个客观的立场上,从赌博的概念和特征入手,考查了赌博活动在中国古代的历史沿革以及国外关于赌博行为的刑事法规制,在此基础上,探讨了赌博罪的处罚依据以及非犯罪化浪潮下的赌博罪非罪化的争议,表明了自己的看法,最后,就完善中国的赌博罪提出了自己的建议。更多还原

【Abstract】 In our history, gambling is an ancient social phenomenon. all people know the gambling with social harmfulness. Gambling and prohibition of gambling almost arise in the same time. Successive rulers have recognized the social harm of gambling, so they have correspondingly adopted denial measure, but gambling can’t be stopped.At present, the situation of gambling in China is somewhat serious and our country basically adopts a prohibit policy to it, and many gambling project which is lawful in other country is unlawful in China. On the one hand, the decriminalization advancement has started in various countries, on the other hand, the gambling unceasingly spread. Facing this kind of situation, what can our criminal law do? This is an issue which is worth of research.About criminalization or decriminalization of gambling, there is a hot argument. The author stands in an objective standpoint, analyzes the concept and features of gambling, then the author gives a introduction of history evolution and legislation of the traditional gambling crime, and studies the legislation overview of gambling crime in the major countries of the world. On this basis, the crime of gambling, as well as non-criminal penalties in accordance with the wave of crimes under the non-crime of gambling controversy, and view my points. Finally, the author improve the recommendations of the crime of gambling.更多还原
