行政公产相关权利救济问题研究

【摘要】 目前,各国正在建立福利国家和给付行政,而福利国家和给付行政最重要的物质手段就是行政公产。行政公产是行政法学上的重要内容,是行政手段之一。行政手段包括:行政主体——人的手段;行政行为——行为手段;行政公产——物的手段。行政公产涉及的权利范畴非常广泛,包括:行政公产所有权、行政公产管理权、行政公产使用权、行政公产致害赔偿权、道路便利权以及环境权等。若建立福利国家和给付行政,充分发挥行政公产物质手段,必须保证行政公产相关权利能够正常行使,所以,应按照权利救济理论,建立健全行政公产相关权利救济体系。应该建立和完善以下制度:建立行政公产制度已明确行政公产相关权利;完善国家赔偿制度,加强行政公产致害赔偿权的救济;建立行政公产公益诉讼制度,加强行政公产所有权、使用权、相邻关系人环境权的救济。更多还原

【Abstract】 At present, countries in the process of establishing a welfare state and benefits administration, and the welfare state and benefit administration means the most important material is public property administration. Public property administration on administrative law are an important aspect, administration are one of the means. Means of administration include:the main administration - means the person; admini-strative acts - acts of means; administration public property - a means of objects. Public property administration relating to the rights of a wide range of areas, including: ownership of public property administration, administrative management of public property, the right to use public property adm-inistration, compensation administration virulence public property rights, the right of the road, as well as to facilitate the right environment. If set up a welfare state and benefit administration, public administration and give full play to the material means of production, administration must ensure that public property can the normal exercise of related rights, so should the right to relief in accordance with the theory of public administration set up a sound production system related to the right to relief. The following should be set up and improve the system: set up public property administration system has been clearly related to the rights of public property administration; National compensation system to improve and strengthen the public administration the right to compensation for the middle class relief virulence; administration set up the system of public property public interest litigation, strengthening public administration capacity ownership, the right to use adjacent relationship between the environment and the right people relief.更多还原
