【摘要】 目前,我国已有一亿多进城务工农民,他们为“三农”问题的解决和城市化、工业化的发展做出了巨大的贡献。但随着农民工群体规模的不断扩大,由此引发的各种矛盾和问题也日益突出,农民工缺乏基本社会保障问题就是其中之一。虽然农民工问题已引起社会各界的广泛关注,农民工的社会保障问题也逐步进入政府视野,但是总的来看,当前各方面对于农民工的社会保障问题还关注不够。出于对此问题的关注,本文运用比较分析的方法、理论联系实际的方法、规范分析与实证分析相结合并侧重实证分析的研究方法,对我国二元社会保障制度进行剖析,探寻解决农民工社会保障问题的思路和对策。论文共分四部分:第一部分通过介绍各学者的研究,对农民工、农民工的分类和社会保障这几个主要概念做出了明确的界定;第二部分从构建和谐社会、提高国家工业化、城镇化水平、实现社会稳定、完善社会保障体系、维护农民工基本权利的角度出发,说明了建立和完善农民工的社会保障制度的必要性;第三部分用事例和数据说明了当前农民工社会保障权益缺失的现状并深入论述了农民工社会保障权益缺失的原因;第四部分是本文的重点,笔者在对农民工社会保障立法模式分析的基础之上,提出了完善农民工工伤保险、失业保险、医疗保险、养老保险、以及“公共劳动”形式的最低生活保障制度的构想。更多还原

【Abstract】 Now there about 200 million farmers working in cities,they contribute a lot to the development of the national economy, including problems of "agriculture, farmers, counties”, urbanization and industrialization. As the number of peasant workers grows bigger,the problems posed by this issue come to be increasingly severe , one of which is the lack of functional social guarantee. Though peasant workers have drawn extensive concern of the society and the government has begun to take it into consideration,to a broad. Extent, we haven’t faced this problem seriously or attached enough attention to it.The article commit comparative analysis method, theoretical and practical method and authentic proof analysis with laying special emphasis on the latter, making analysis on our country’s binary social security system and trying to find proper views and solutions to peasant workers’ social guarantee.And this article is consistent of the following parts:Firstly, we bring about clear definitions of peasant worker, peasant worker classification and social guarantee. Secondly, we clarify the emergency and necessaries of establishing and consummating peasant workers’ social guarantee system from the prospective of building coordinative society, maintenancing social stability enhancing the levels of industrialization and urbanization, intensifying social guarantee and meeting the demand of survival and development of peasant workers. Thirdly, we hold a profound-discussion about the current situations of peasant worker slack of rights and its reasons by displaying some examples and data. Fourthly, the chapter is this article key point, this article advances new ideas of series of security systems on labor injury Insurance, unemployment insurance, medical treatment insurance, retirement pension insurance, and the lowest living security system of public work.更多还原
