【摘要】 环境责任保险制度是环境侵权责任风险社会化的产物,它通过运用市场机制的手段来解决环境侵权损害赔偿的问题,能够及时有效地弥补受害人的损失,保障受害人的合法权益,分散企业的经营风险,利用费率杠杆机制促使企业加强环境保护,维护生态系统的平衡,促进资源的可持续利用,有利于企业的健康运行,维护社会的稳定,减轻政府的负担,可以比较好的弥补一般侵权行为法理论的不足,因而它的产生与发展日益受到世界各国的重视和关注。虽然环境责任保险制度有着很积极的意义,但是目前在我国实施的情况并不乐观,与之配套的相关制度也没有建立起来。因此,加快我国环境责任保险制度的构建,是切实推进环境保护历史性转变的迫切需要,是环境管理与市场机制有机结合的有益尝试。本文拟通过对环境责任保险的概述、基础理论、西方主要国家对于环境责任保险的立法和司法实践、我国的环境责任保险制度的现状和不足等问题的研究,以期为我国构建和完善环境责任保险制度提供建设性的意见。本文将分为四个部分进行论述,第一部分是环境责任保险的概述,主要介绍环境责任保险的概念、特征、产生与发展的过程等,突出介绍了环境责任保险的优点,包括可以及时有效地弥补环境侵权受害人的损失、防止政府用全体纳税人的钱来分担私权侵害的结果等,以期引起读者对环境责任保险制度的重视;第二部分是对环境责任保险基本理论的研究,包括环境责任保险与侵权行为法之间的关系以及建立环境责任保险制度的必要性研究,这是我国环境责任保险制度赖以实施的基础;在第三部分对西方主要国家环境责任保险制度的产生、发展实践进行比较分析,探索各国不同模式下的环境责任保险制度在立法和实践中的优势和不足,以期对我国的环境责任保险制度的构建有所启示;第四部分介绍环境责任保险制度在我国发展的现状以及为我国如何构建环境责任保险制度提出自己的设想和立法建议。更多还原

【Abstract】 Environmental liability insurance system is the outcome of environment damage responsibility risk socialization,It solves the environmental damage compensate problem using market mechanism’s method,safeguards victim’s legitimate rights and interests effectively and promptly,makes up victim’s loss,scattered enterprise operational risk,urges the enterprise using the tariff release lever mechanism to strengthen the environment risk management,maintenance ecosystem balanced, promote resources sustainable use,Is advantageous in enterprise’s health movement, maintenance society’s stability,lightens government’s burden,deficiency being able to make up general law of torts theory comparatively well,therefore its production and the development receive various countries day by day the value and the attention. Although the environmental liability insurance system has the very positive significance,present implements in our country is not optimistic,has not established with it necessary related system.Therefore,speeds up our country environmental liability insurance system’s construction,is urgent need which the practical advancement environmental protection historicity transforms,is the environmental management and the market method organic synthesis beneficial attempt.This article plans through to the environmental liability insurance system’s sketch, basic theory,various countries regarding the environmental liability insurance legislation and the judicial practice,our country’s environmental liability insurance question and so on to look forward to being that our country structures and perfects environmental liability insurance with the constructive opinion.This article will divide into four parts to carry on the elaboration,the first part is the environmental liability insurance system’s outline,the main introduction is environmental liability insurance’s concept,the characteristic,produce with the development process,including may make up the environmental pollution victim’s loss,prevent the government effectively and promptly to share the private power violation with all taxpayer’s money and so on,causes the reader by the time to the environment liability insurance system’s value;The second part is to the environmental liability insurance elementary theory research,including environmental liability insurance and between abuse of authority law relations as well as establish environmental liability insurance system’s necessary research,this is the foundation which our country environment liability insurance system depends implements;In the third part to the Western major country environmental liability insurance system’s production,the development practice carries on the comparative analysis,under the exploration various countries’ different pattern’s environmental liability insurance system in legislates and in the practice superiority and the insufficiency,in order to give help to our country’s environmental liability insurance system’s construction.;The fourth part introduced how the environmental liability insurance system’s present situation which as well as develops in our country constructs the environmental liability insurance system for our country to make own tentative plan with the legislative suggestion.更多还原
