教育学视野下中小学校职务犯罪预防研究

【摘要】 本论文主要侧重于对当前中小学校所发生的职务犯罪的现状与相应对策的思考,其核心思路是探明当前N市中小学校职务犯罪逐年递增的根源所在,以教育学为视野,提出解决的主要途径和对策。具体而言,论文引言部分首先从职务犯罪研究的背景、意义入手,对国内外研究的现状进行分析;其次,对教育系统当前职务犯罪预防工作的重要性和特殊意义进行分析,尤其对中小学校职务犯罪的特殊影响进行分析,为从教育学视角探讨中小学校职务犯罪的预防进行必要的铺垫。其次是对职务犯罪概念进行界定。因为本论文涉及犯罪问题的讨论,就必须涉及法律领域的对这一概念的认识。职务犯罪本身就是一类犯罪行为的称呼,在各国以及我国的不同时期对哪些行为属于职务犯罪有着一些争论。所以行文中尽量使用法律语言进行描述,主要从该类犯罪构成的主体、客体、主观方面、客观方面进行分析,得出关于职务犯罪的一般概念。在此基础之上,进而分析教育领域职务犯罪的常见罪名以及基本特征。论文第一章,结合N市中小学校中的职务犯罪实际案例,对中小学校职务犯罪的特征进行分析。结合1999年至2006年N市人民检察院查处的典型案例进行归纳分析,指出当前中小学校中的职务犯罪主要发生在学校基础建设、教材采购、教师调动、财务管理等领域,具有涉及面广、团体作案多、主体较集中、手段多样隐蔽性大、涉案金额逐年递增、社会影响尤其是对青少年学生影响较大的特点。论文第二章,结合N市中小学校中的职务犯罪实际案例,对中小学校职务犯罪产生的原因进行分析。结合案发学校的实际情况和犯罪人的悔过书对中小学校的职务犯罪产生的客观原因和主观原因进行分析,有重点地分析阐明N市中小学校中职务犯罪易发的根源主要在于区域经济因素影响,教师收入较低;校长权力相对集中、松弛的学校管理制度、管理人员在市场经济冲击下心理失衡、法律意识淡薄;最后,对现有教育系统尤其是中小学校对职务犯罪预防体系的不足进行论证,为后文有针对性地提出预防措施打下基础。论文第三章,重点提出中小学校职务犯罪预防对策。从立法、构建教育监督制度并重的预防体系,到具体的制度防范、家庭防范、个人预防等不同方面提出预防教育对策,指出中小学校管理者必须树立依法治校理念,中小学校要建立和完善教育、制度、监督并重的预防体系。进一步提出了加快进行基础教育领域职务犯罪预防的立法工作。结语部分对本文的突破之处和有待进一步深化的地方做分析。

【Abstract】 The present paper mainly stresses on the crime by taking advantage of duty present situation which and the corresponding countermeasure ponder occurs to the current middle and elementary schools, its core mentality is the root which the proving current N city Middle and elementary schools crime by taking advantage of duty increases progressively year by year is, take the pedagogy as the field of vision, proposes the solution main way and the countermeasure.Specifically speaking, the paper introduction part first from the crime by taking advantage of duty research’s background, the significance obtains, carries on the analysis to the domestic and foreign research’s present situation; Next, carries on the analysis to the educational system current crime by taking advantage of duty prevention work’s importance and the special significance, especially carries on the analysis to the middle and elementary schools crime by taking advantage of duty’s special influence, for carries on the essential upholstery from the pedagogy angle of view discussion middle and elementary schools crime by taking advantage of duty’s prevention. Next is carries on the limits to the crime by taking advantage of duty concept. Because the present paper involves the crime question the discussion, must involve the legal domain to this concept understanding. The crime by taking advantage of duty is in itself a kind of criminality name, which behaviors belongs to the crime by taking advantage of duty in various countries’ as well as our country’s different time to have some arguments. Therefore in the issue document uses the legal language to carry on the description as far as possible, mainly from this kind of crime constitution’s main body, the object, the subjective aspect, the objective aspect carries on the analysis, obtains about the crime by taking advantage of duty general concept.
