【摘要】 近年来,我国现行土地征收制度成为社会关注的焦点问题。随着我国经济建设的快速发展和农村城市化进程的加快,各地招商引资力度加大,各种开发区及特色园区的兴建等直接导致用地需求大量增加,土地被大量征收。土地作为一种重要的资源和财产,隐含着巨大的经济价值和社会效益,屡屡发生于各地的因土地征收而引发的恶性事件更是将这项攸关民生与民权的核心问题推向风口浪尖。以往土地征收多由公法调整,然而由于立法本身存在内在冲突和漏洞,又加上观念、制度、操作等方面的问题,造成土地征收中公权侵害私权的情况时有发生,并产生了严重的社会后果。我国《物权法》第一次以民事法律的形式对土地征收加以规定,反映了市场经济对于私权保护的要求,土地征收不再仅仅是公法领域的问题。土地征收涉及到征收行为性质、征收目的,被征收土地涉及的民事权利以及补偿救济等,这些核心问题无一不关系到民众之私权。本文从民事角度出发,注重私权保护,拟重新界定土地征收民事法律性质;严格明确公共利益内涵与适用原则;细化征收土地民事权利,加大权利保护范围;建立公平市场价格为标准的土地征收补偿制度,注重隐性损失的补偿,将补偿落实到具体个人;针对土地征收中权力的危险性,采取民事救济的方式加强对于私权利的救助。更多还原

【Abstract】 In recent years, China’s Land Imposition System has emerged as a field prone to disputes. Along with the economics fast development in our country and urbanization process’s speeding up, all localities invites investments in larger scale and various kinds of development zones and characteristic garden area are built, which lead to the result that demand for land increases greatly and that massive collective lands in countryside are levied. As a kind of important resource and property, land is a vast storehouse of economic value and social efficacy. Malignant incidents which frequently occurred in some land by land imposition push this problem to the highlights.Anciently the issues of Land Imposition all are settled by public law, yet the present land imposition legislation itself has some intrinsic conflicts and loopholes and there are problems in the ideas, the system and the operation, which create the serious problems in land imposition and serious social consequences. The Land Imposition Issues firstly are prescribed by civil law from the issuing of Property Law of China’, it demonstrates that the demand of protection of private right in market economic, the Land Imposition has not been only a public law’s problem. The Land Imposition is dynamic process, from its character, purpose, civil rights being protected in Land Imposition to compensation and relief , all the issues are concerning civil rights of citizen. The author takes the civil law’s opinion, demonstrates the private rights, redefines the civil law’s character of Land Imposition; changes legislation concept to define the concept of public interest and principle of using in Property Law of China; refines the civil rights of levied land and enlarge the gamut of right protection; sets up the system of land imposition’s compensation, take the fair market price as the norm, refines the compensation items, pay attention to recessive loss, pay the money to individual; takes the civil relief methods to prevent the danger of public power. The paper analysis and designs the issues all above to protect the individual’s land rights and interests and to promote the sustainable development of our country’s economy.更多还原
