【摘要】 封建主流法律思想是指在中国封建社会的不同历史时期成为当时的法制指导思想,决定着法律制度的基本属性,并能被统治阶层和知识阶层甚至社会大众的大多数成员所认可和接受的法律思想。在封建社会,主流法律思想发展的脉络十分清晰,它曾在战国秦朝、西汉初期和西汉中期经历过几次重大地转型,法家思想、黄老思想、儒家思想先后成为封建社会占统治地位主流法律思想,这种变化呈现出明显的阶段性,并有一定规律可循,即:法律思想的演变总是与历史的发展保持高度的同步性;主流法律思想的理论形态和思想体系须不断发展完善;主流法律思想必须顺应中国的文化传统。此外,主流法律思想的演变也反映出价值取向的变化。各家学派在法律思想方面各有侧重,伴随着主流法律思想的改变,统治者价值取向也有所改变。战国秦朝时期,功利主义的价值取向盛行;西汉初期,因循自然的价值取向曾显赫一时,决定着实践活动的方向和性质;西汉中期以后,重视人与道德的价值取向贯穿了封建社会的中后期。通过对中国封建主流法律思想的深入研究,我们可以进一步加深对中国封建法制内容、特征、发展规律、数千持续发展而不中断的深层原因等诸多问题的理解,并能够更多地发掘出中国传统法律文化的价值,从中找到发展现代法治文明的内部力量。更多还原

【Abstract】 Federal Mainstream Law Thoughts refers to the guiding thoughts of legal system of the time in different historic periods of Chinese Federal Society, which determined the fundamental attribute of legal system, ratified and accepted by ruling class and intelligentsia or even by most of social masses. In the Federal Society the development sequence of mainstream law thoughts was very clear. It experienced several significant evolutions in Qin Dynasty of Warring States, in the outset and mid-term of the Western Han Dynasty when thoughts of Legalists, Huang and Lao, Confucianists became ruling mainstream law thoughts by terns. These movements showed distinct timeframe, and followed certain pattern, that is, the evolvement of law thoughts must always be highly synchronal with development of history, the theory and thought system of mainstream should be kept on developing and perfecting, and it must matched cultural tradition of China. In addition, the evolution of mainstream law thoughts also reflected the changes of value orients. Different schools emphasized different aspects of law thoughts, and along with evolution of mainstream law thoughts the value orient of dominators changed. In Qin Dynasty of Warring States utilitarian value orient was popular, in the outset stage of Western Han Dynasty the value of follow-the-nature was celebrated, determined the direction and character of practice, after mid Western Han Dynasty value orient of focusing on people and moral last through the mid and final stage of federal society. Help by study on mainstream law thoughts of federal china, we can deeper our understanding of contents, attributes, evolution rules of federal mainstream law thoughts , and why it was never interrupted for thousands of years, and find out from it some interior strength for modern development of law civilization.更多还原
