【摘要】 本文运用了比较分析法、历史分析法等多种方法,对我国和外国的工伤保险.与侵权赔偿关系进行了系统的分析和探讨,全文共分为六个部分。第一部分,对工伤事故的概念,特点以及工伤事故责任的概念、性质和构成进行界定和理论探讨。第二部分,首先,对工伤保险与侵权赔偿的联系和区别进行了理论分析。其次,对工伤保险与侵权赔偿的竞合的含义,特点及处理两者竞合时的难点进行了理论探讨。第三部分,从三个方面分析了决定工伤保险与侵权赔偿关系的因素。第四部分,归纳总结出了世界范围内存在四种处理工伤保险与侵权赔偿关系的模式,并对各种模式的优点和缺点进行了理论探讨。第五部分,对建国以来的有关两者关系的立法进行了全面的的总结和分析,并对我国的理论主张和司法实务进行了探讨。第六部分,首先,对我国现行立法规定的不足进行了分析,并区分未参加工伤保险的情形与参加工伤保险的情形进行分析,在针对上述规定不足的基础上提出相应对策。其次,对我国未来立法中应如何合理建构工伤事故的赔偿模式提出了有益的途径。更多还原

【Abstract】 In order to analyze the RBEIITC deeply and systematically,various methgds are applied in the thesis,such as method of comparative analysis,method of historical analysis and so on.It includes 6 parts.The first part is mainly about the basic theory.It introduces the concept and the characteristics of the EIA,as well as the concept,character and the composing of the responsibility of the employment injury accident.This part is written to solve the fountainhead of the RBEIITC.The second part is comparatively analyze the affiliation and the differences between the employment injury insurance and the compensation for the compensation for the infringement.The third pan is concerning the decisive factors of the the RBEIITC.The following pan is on the use of reference of the experience of the foreign countries.First it summarizes four patterns of the RBEIITC worldwide,and then it probe into the merits and drawbacks of the each pattern theoretically.This part is written to provide useful revelation and references to our society.The next part mainly discusses the actuality of legislation and the actual practice of judicature in our country.Before the deep discussion,it analyzes and summarizes the legislation on the RBEIITC from the foundation of PRC across-the-board.The last pan is the emphasis of the thesis,which makes several helpful suggestions.First,it analyzes the shortages of the actuality of legislation,as well as the differences under the circumstances whether the subject has purchases the employment injury insurance;then it proposes some useful advices accordingly on the basis of the above-mentioned shortages;at last,it makes some useful suggestions on how to found a rational relief pattern in the legislation of our country in future.更多还原
