农村集体建设用地使用权流转问题的研究

【摘要】 随着社会经济的发展,农村集体建设用地使用权流转已成为客观需要。但由于现行法律法规限制农村集体建设用地入市流转,致使农村集体建设用地流转一直呈隐形状态。农村集体建设用地的自发、隐形流转,已严重破坏了我国的土地市场秩序,给国家、集体及公民个人造成了重大损失。作为整个城乡土地市场不可或缺的组成部分,农村集体建设用地市场的培育和发展已显得十分重要。所谓农村集体建设用地,主要是指集体所有的用于建造建筑物、构筑物的土地,包括现有的建设用地和经批准办理农用地转用手续的农用地。本文在对农村集体建设用地进行了界定后,分三部分阐述:第一部分农村集体建设用地使用权流转的现状、存在的问题和原因:当前,农村集体建设用地使用权的流转已经普遍存在,流转方式有出让、转让、出租和入股等多种形式。特别在经济发达的沿海地区以及大中城市的郊区,集体建设用地使用量占总建设用地使用量的比例尤高。农村集体建设用地使用权流转因受种种限制,仅能在本级集体范围内简单地流转,加之资金、人才缺乏,基础设施、技术落后,交通、信息闭塞等,利用率不高,浪费闲置严重,同时也产生了许多隐患问题;比如:农村土地市场流转秩序紊乱,隐形交易市场大量存在;征地范围不断扩大,腐败行为滋生;农民利益受损,干群关系恶化。接着分析了农村集体建设用地使用权自发流转的原因;包括土地自身价值利益的驱动,用地结构调整的需要,建设用地需求的拉动等经济原因、法律原因和体制原因,比如:产权界定不清晰、管理体制不科学、征地制度不合理等等。第二部分:从六个方面分析了农村集体建设用地使用权流转的必然性和现实意义:有利于打破城镇土地国有、农村土地集体所有的二元地域格局,推动城乡一体化发展;有利于规范征地市场,确保集体土地所有者权益;有利于增加农民货币净收入,减轻企业负担;有利于乡镇企业的改制,促进小城镇的建设;有利于增强农民珍惜土地的情悻,盘活集体土地存量;有利于加速农村产业结构调整,推动农村剩余劳动力转移。最后在第三部分得出了完善农村集体建设用地使用权流转的对策和措施。在总结各地实践经验的基础上提出了集体建设用地使用权流转的制度设计方案和发展、完善农村集体建设用地流转的具体对策措施。

【Abstract】 By the developing of the economic, the circulation of right to the use of collective construction land have been need, However, existing laws and regulations restricting rural collective construction land market circulation, resulting rural collective construction land circulation has been on the stealth state. Rural collective construction land spontaneous, stealth circulation, has seriously undermined the nation’s land market order, and to the state, the collective and individual citizens caused heavy losses. The entire urban and rural land market as an integral part of rural collective construction land to nurture and develop the market has become very important. The so-called rural collective construction land, mainly refers to the collective for the construction of all buildings, structures of the land, including the existing building space and agricultural land have been approved for the procedures to use agricultural land.After the collective construction land in the rural areas were defined,describes on three parts: The first part, the problems and reasons of the right for the rural collective construction land: At present, the circulation of rural collective construction land has been widespread circulation of ways to sell, transfer, lease, and investment and other forms. Especially in the economically developed coastal areas and the outskirts of major cities, the collective use of the land for building construction sites account for the use of the proportion of particularly high. Rural collective construction land use rights transfer due to various restrictions, only in the context of the collective-simple circulation, and the funds, lack of personnel, infrastructure, backward technology, transport, information occlusion, the utilization rate is not high, a serious waste of idle , It has also produced many hidden dangers; For example: the rural land market order flow disorder, there are a lot of invisible trading market; Continuously expand the scope of land requisition, and the breeding of corruption; damage to the interests of farmers, the cadres and the masses deteriorated. Then of rural collective construction land spontaneous circulation of the reasons for the value of their land, including the interests of the drive, the need for structural adjustment, construction sites, such as stimulating demand for economic reasons, legal reasons and institutional reasons, such as: define property rights are unclear, management institutional unscientific, the land requisition system unreasonable, and so on .PartⅡ: from six aspects Analysis the necessity and practical significance For crculation of the Rural collective construction land: help to break the state-owned, collectively owned rural land binary geographical pattern, and promote the integration of urban and rural development; help to standardize land market and ensure that the collective land rights and interests of owners; heip to increase net income of farmers currency, reducing the burdens of enterprises; heip to the restructuring of township enterprises, promote the development of small towns; help to enhance the value of land farmers intelligence, utilizing the collective land stock; help to speed up adjustment of industrial structure in rural areas, and promote the transfer of rural surplus labor force.Finally, in the third part , Perfect the circulation for the Strategies and measures of theland for collective construction in the rural areas .In summing up practical experience on the basis of a collective transfer of the land for building the system design and development, improve the rural collective construction land transfer of the specific countermeasures.
