农村集体建设用地使用权流转问题的研究

【摘要】 随着社会经济的发展,农村集体建设用地使用权流转已成为客观需要。但由于现行法律法规限制农村集体建设用地入市流转,致使农村集体建设用地流转一直呈隐形状态。农村集体建设用地的自发、隐形流转,已严重破坏了我国的土地市场秩序,给国家、集体及公民个人造成了重大损失。作为整个城乡土地市场不可或缺的组成部分,农村集体建设用地市场的培育和发展已显得十分重要。所谓农村集体建设用地,主要是指集体所有的用于建造建筑物、构筑物的土地,包括现有的建设用地和经批准办理农用地转用手续的农用地。本文在对农村集体建设用地进行了界定后,分三部分阐述:第一部分农村集体建设用地使用权流转的现状、存在的问题和原因:当前,农村集体建设用地使用权的流转已经普遍存在,流转方式有出让、转让、出租和入股等多种形式。特别在经济发达的沿海地区以及大中城市的郊区,集体建设用地使用量占总建设用地使用量的比例尤高。农村集体建设用地使用权流转因受种种限制,仅能在本级集体范围内简单地流转,加之资金、人才缺乏,基础设施、技术落后,交通、信息闭塞等,利用率不高,浪费闲置严重,同时也产生了许多隐患问题;比如:农村土地市场流转秩序紊乱,隐形交易市场大量存在;征地范围不断扩大,腐败行为滋生;农民利益受损,干群关系恶化。接着分析了农村集体建设用地使用权自发流转的原因;包括土地自身价值利益的驱动,用地结构调整的需要,建设用地需求的拉动等经济原因、法律原因和体制原因,比如:产权界定不清晰、管理体制不科学、征地制度不合理等等。第二部分:从六个方面分析了农村集体建设用地使用权流转的必然性和现实意义:有利于打破城镇土地国有、农村土地集体所有的二元地域格局,推动城乡一体化发展;有利于规范征地市场,确保集体土地所有者权益;有利于增加农民货币净收入,减轻企业负担;有利于乡镇企业的改制,促进小城镇的建设;有利于增强农民珍惜土地的情悻,盘活集体土地存量;有利于加速农村产业结构调整,推动农村剩余劳动力转移。最后在第三部分得出了完善农村集体建设用地使用权流转的对策和措施。在总结各地实践经验的基础上提出了集体建设用地使用权流转的制度设计方案和发展、完善农村集体建设用地流转的具体对策措施。更多还原
