【摘要】 犯罪本质上是一个社会问题,是社会多种因素交合作用而产生的社会实践产物。为减少犯罪,维护社会和谐,必须依靠社会的力量和社会化的手段。当今世界已呈现“人道、文明、进步”的发展总趋势,行刑社会化和开放化已备受关注并渐次推行。大势所趋,我国行刑理念、监狱制度面临着深层次的价值创新和观念调整。监狱行刑社会化能缓解监禁的压力,降低行刑成本,提高罪犯改造质量,使罪犯顺利回归社会,但目前我国在这方面还存在着若干问题。本文概述了监狱行刑社会化存在的问题,并深入剖析了其成因。通过借鉴国外监狱行刑社会化的经验做法,立足于基本国情,系统地探讨了我国推进监狱行刑社会化的对策,同时针对湖南省德山监狱作了具体的实证分析。本文分为四章。第1章为绪论。阐述了选题的背景和意义,对国内外的研究现状进行了分析,并就监狱行刑社会化的内涵作了阐释,说明了研究的主要内容、主要方法及特色与创新点。第2章为我国监狱行刑社会化存在的问题及原因分析。深入分析我国监狱行刑社会化的现状和存在的问题,并系统地剖析了存在的原因。第3章为国外监狱行刑社会化的经验借鉴。对欧美、日等国家监狱行刑社会化的一些典型做法进行了罗列和陈述,尤其是对我国极具借鉴意义的一些思路、举措作了分析和推介。第4章为我国推进监狱行刑社会化的对策。根据存在的问题及原因分析,借鉴国外的先进经验,立足我国的基本国情,对我国推行监狱行刑社会化的对策进行了开创性的研究。并运用其中的一些基本思路,原则和方法,结合湖南省监狱系统特别是德山监狱的实情,作了具体的针对性操作性都较强的实证研究。我国监狱行刑社会化尚缺乏政策制度的保障,理论探索还不系统,实践经验也欠缺。本文的探讨对推进和规范我国监狱行刑社会化工作,具有重要的实践意义。更多还原

【Abstract】 Essentially,Crime is a social problem,a product of social practice made by variety of social factors.It must rely on the strength of the community and means of socialization to reduce crime and maintain social harmony.There is a general trend of humane,civilized and progressive,socialization and opening up of execution has been much concern and gradually implemented,and so the concept of execution,the prison system in China. Socialization of prison execution can ease the pressure of imprisonment,lower execution costs and improve the quality of criminals,and let criminals smoothly return to society, but regard to this there is a number of issues in China.The paper here provides an overview of the issues existed in socialization of prison execution,and deeply analyses their causes.By drawing experience and practices of foreign socialization of prison execution,based on our basic national conditions, systematically promote the countermeasures of socialization of the prison execution.At the same time,we made empirical analysis on De Shan Prison in Hunan Province. This paper is divided into four chapters.Chapter 1,the introduction,explains the background and significance of the research,analyses the status quo at home and abroad, explains the connotations of socialization of prisons execution,the main contents,features and innovative of the study.Chapter 2,analysis on the execution of theprison community of the problems and the reasons.Chapter 3,experience of socialization of prisons execution the execution in foreign countries,draws some meaningful ideas to promote Chinese socialization of prisons execution.Chapter 4,promoting Chinese socialization of prisons execution.According to the existing problems and the reasons,lern from the advanced experience of foreign countries,based on our basic national conditions and the execution of the prison community of countermeasures to be taken in a groundbreaking study,and use some of these basic ideas,principles and methods in light of the prison system,especially in Tak Hill Prison in Hunan Province facts.Socialization of prisons execution in China is still lack the protection of policies and systems,systematic theoretical exploration,and practical experience.Discussion on promoting and regulating socialization of prisons execution has important practical significance.更多还原
