【摘要】 城市规划编制是城市规划工作的基石,城市规划编制得当与否对城市规划的意义重大。然而,城市规划编制的现状已明显滞后于现实的需要,这就不可避免地造成实践的混乱,不断增多的规划纠纷,给社会的稳定、经济的发展造成了危害。因此城市规划编制体系面临改革与完善的困境。尽管《城乡规划法》在2008年1月1日已经施行,相关的配套法规还不健全。而在我国当前的城市规划编制领域,其理论研究往往局限于城市规划编制本身一些技术性问题,而很少从行政法的角度深入探讨我国当前城市规划编制法制的不足与完善。在城市规划编制制度中,程序制度具有特殊的重要性,只有通过公正、合理、权威的城市规划制定程序制度,才能确保公众的参与权,规范规划法律关系主体的行为,达到权利与权力的总体平衡和结构平衡。本文尝试从行政法的视角来设计公众参与城市规划编制制度,以保证城市规划编制目标的实现。本文除引言和结语外,正文部分共四章。以下就是本文论述的基本脉络。引言主要阐述进行城市规划编制研究的现实背景,提出从法治角度审视城市规划编制,重构法律控制下的规划体系;第一章,城市规划和城市规划编制。主要阐述城市规划和城市规划编制的概念、内容、法律体系和分类等,为以下的论述做好基础理论准备;第二章,用行政法的视角研究分析城市规划编制。本章主要是通过行政法的视角来研究城市规划编制行为,将城市规划编制行为定义为“第三”种抽象行政行为;第三章,国内外的城市规划编制的现状。通过与美国、英国、德国和日本城市规划编制程序的对比,探讨了我国现行城市规划程序的缺陷;第四章,关于完善我国的城市规划编制法律制度的构想。在对我国现行规划编制体系的反思的基础上,提出了城市规划编制体系的新框架。同时,“公众参与”作为一种方式,应当成为城市规划编制的重要一环,值得大力倡导。更多还原

【Abstract】 Urban planning formulation is the foundation of urban planning, which has great significance to urban planning. However, the present condition of the urban planning formulation has been far behind the practical need, which inevitably leads to the confusion of practice and more planning issues inevitably. It is really harmful to a stable society and developing economy. Therefore the urban planning formulation system in China is facing a puzzle Dom of reform and perfection. Although <Urban and Rural planning Act of PRC> is carried out since January.1 2008, relevant regulations are still incomplete. However, in the field of present urban planning formulation, theory researches have been limited in technical problems of urban planning formulation, and it seldom probes into the shortage and imperfection problem of the state present urban planning formulation from the spectra of administrative law. The procedure system is of special importance in the urban planning formulation system. Only through fair, reasonable establishment of procedure system, authoritative of urban planning can ensure public participation rights; standardize the behaviors of the artificial persons and general and structure of right and Power. This paper tries to design the public participation system of urban planning formulation from the visual angle of the administrative law, so as to ensure the realization of the goal of the urban planning formulation.There are 4 chapters in this composition besides the foreword and tag. In the abstract, I would introduce the basic logic of the composition. The foreword part dwells on the environment of urban planning formulation study, proposes urban planning formulation survey according to constitutional angle and restructures the planning formulation system under the law control. Chapter 1, urban planning and urban planning formulation. The first chapter goes the brief introduction, the concept, content, the legal system and classification of urban planning and Urban planning formulation, which is as the theory preparation for the following discussion. Chapter 2, the analysis on the urban planning formulation from the visual angle of the administrative law. This chapter mainly talks about the urban planning formulation behavior from the visual angle of the administrative law, and definite urban planning formulation behavior for“the third abstract administration behavior”. Chapter 3, the general situation of domestic & overseas urban planning formulation. By contract with urban planning procedure in America England Germany and Japan,this chapter probes into the shortage of the state present urban planning formulation. Chapter 4, the tentative plan of perfecting the urban planning formulation law system in china. The new frame for the urban planning drawing-up system is raised based on the re-viewing of the existing one. And public participation should be greatly advocated and made an important part in the process of urban planning formulation.更多还原
