【摘要】 本文运用历史考察、价值分析和实证分析等方法,对智力障碍者生育权的保护和限制问题进行了深入研究,希望能为智力障碍者的权利保护提供相应的法理依据。智力障碍者的生育权问题面临着两难的道德困境。人类的生育应当是“负责任”的,但是,剥夺智力障碍者生育子女的权利在道义上和法理上又得不到合理的论证。因此,在法律上应当确认智力障碍者享有生育权,但应当受到合理的限制。由于智力障碍者的特殊生理条件,智力障碍者选择生育必然带来各种利益的冲突,智力障碍者选择不生育又可能引发道德风险,因此,智力障碍者生育权的行使应当遵循特殊的原则,适用特殊的规则。对智力障碍者生育权进行法律保护应当遵循的基本原则主要有:智力障碍者的生育权主体资格不可剥夺原则,知情同意原则,程序正义原则。智力障碍者生育权的行使应当遵循下列规则:智力障碍者应理性选择结婚,智力障碍者应理性地自主决定生育,他人代作决定应具有正当性。对智力障碍者生育权进行限制应坚持以下几个原则:应当准许对重度、极重度智力障碍者实施非自愿性的绝育手术,对智力障碍者实施绝育手术应当具有充分的医学证据,符合不伤害原则的要求和智力障碍者的最佳利益,法院拥有最终决定权。更多还原

【Abstract】 The author applies methods of history investigation, worth analysis and substantial evidence analyze to research how we can protect and restrict reproduction rights of people with mental retardation.Reproduction rights of people with mental retardation faces morals difficulty, which reproduction of people should be responsible and the deprival of reproduction rights of people with mental retardation proved to be unreasonable both on moral and law. So the law should confirm that people with mental retardation should have rights of reproduction which should be limited.Because of the special physiology condition, people with mental retardation deciding to have their children by all means conflict in various benefits, so it should follow a special principle to protect and limit reproduction rights of people with mental retardation.The basic principles of protection of reproduction rights of people with mental retardation include: reproduction rights of people with mental retardation should not be deprived, principle of informed consent, principle of procedure justice. The basic rules of protection of Reproduction rights of people with mental retardation include: matrimony chose by people with mental retardation should be reasonable, reproduction chose independently by people with mental retardation should be reasonable, decisions made by other people should be justifiable.Restriction on reproduction rights of people with mental retardation should follow the following rules: obliged sterilization for people with serious mental retardation should be permitted, should have full medical evidences, should accord with principles of no harm and their benefits, the final decisions should be made by the courts.更多还原
