试论和谐劳动关系的构建

【摘要】 社会关系多样复杂,其中一个重要的社会关系是劳动关系。建设和谐的劳动关系是构建和谐社会的重要组成部分,党的十七大又将其作为重要战略部署。经过二十多年的改革和发展,市场经济体制在我国已经逐步确立,社会经济成分、组织形式、就业方式、分配形式和利益关系日趋多样化,劳动关系的主体结构、主体地位、主体利益、规范和调节方式、劳动力配置方式也随之发生了深刻而巨大的变化,呈现出空前复杂的局面。研究这些变化,把握其特点,掌握其规律,对于构建和谐劳动关系,进而构建和谐社会无疑具有重要意义。而如何构建和谐的劳动关系,既是社会关注焦点,也是政府需要着力解决的难点,还是学界专家学者纷纷倾力关注的重点。本文在汲取既往研究成果的基础上,以马克思劳动价值理论为指导,从劳动和劳动关系的本质属性和历史考查入手,就新时期的劳动关系的发展变化和构建和谐劳动关系的必要性、构建思路和途径,尝试性地进行了分析和研究。笔者认为,和谐劳动关系主体是政府、企业、工会和劳动者本身,劳动关系主体特征、相互关系和责权通过实践来表征,劳动关系主体在实践中形成矛盾体,既相互对立,又相互统一。构建和谐劳动关系并不是要彻底消除矛盾,而是使矛盾双方更好地实现协调、融洽、合作。

【Abstract】 The social relationship is various and complicated,the important one of it is the work relationship.To construct the harmonious work relationship is a significant component of constructing the harmonious society,so the 17th congress of the Communist Party takes it as an essential strategy deployment.Over twenty year’s reforming and development in China,the market economy system has been set up,and the social economic components、organization styles、employment ways、distribution forms and benefit relationship are getting diversified day by day.The subjective structure、subjective status、subjective benefit、norm and adjustment forms and the laborer disposition ways of labor relationship changed greatly and profoundly,it displays a situation of unprecedented complexity.To study these variations,grasp its characteristic and regular patterns embodies the significant meaning in constructing the harmonious work relationship and harmonious society.As for how to construct the harmonious work relation,not only it is a focus of social concern,but also it is the difficult for the government to settle by exerting its strength.Furthermore,it is also the key point which specialists and scholars pay close attention as they do all they can.Based on the past research achievement,in this dissertation,under the guidance of the work value theory of Marx,I attempted to analyze and study the development and variation of the work relationship in the new times with a vision of intrinsic attribute and history investigation of work and work relationship,also I analyzed and studied the importance、the train of thought and the gateway of constructing the harmonious work relationship.In my opinion,the subject of the harmonious work relationship should be the government、enterprise、labor union and the laborer himself.And the character of the subject、interrelation、right and responsibility in the work relationship can be characterized in a way of practice.The subject in the work relationship forms the contradiction community in practice,they not only inter-opposite but also inter-integrate.Not that we construct the harmonious work relationship to eliminate the contradiction completely,but that we want to realize the coordination、harmony and cooperation comparatively in the manual contradiction sides.
