民事强制律师代理制度研究

【摘要】 当前正在进行的民事审判改革中,强化当事人的诉讼参与性已成共识,相应地律师代理在诉讼中的作用变得越来越重要。强制律师代理是律师代理的特殊形式,德国等国将其确立在民事诉讼法中,从而形成了强制律师代理制度。民事强制律师代理制度,是指在民事诉讼的一定领域内,当事人或其法定代理人进行诉讼必须委托律师代理完成诉讼行为的一项制度。从为自由而限制自由、程序正义、促进法律对话和民事诉讼的本质等角度对民事强制律师代理制度进行法理学分析,再从经济学的角度分析其与诉讼效率、诉讼成本的关系,可以发现,民事强制律师中的“强制”是具有正当性的,其能够提高诉讼效率和节约诉讼成本。对两大民事诉讼模式下的民事强制律师代理制度进行比较法研究,可以发现,在英美型当事人主义模式中,律师代理制度都较完备,对律师的依赖程度高;在德法型职权主义模式中,许多国家也都实行了强制律师代理,进而得出确保律师充分代理民事诉讼是不同民事诉讼模式的共同选择的结论。我国引入民事强制律师代理制度,符合律师职业发展和民事诉讼立法的双重需求,符合程序严密化和司法改革的需求,具有必要性。同时,我国法治的发展和日趋成熟的律师行业以及公民法律意识的日益强化为引入该制度提供了可行性参考。我们应对民事强制律师代理制度从观念、立法、制度保障三方面进行本土化构建,发挥出其特有的价值,促进和谐社会的达成。更多还原

【Abstract】 During the present reforms of civil trials in the ascendant, strengthen litigant’s lawsuit participation has become a mutual recognition, correspondingly the lawyer agent in the proceeding becomes more and more important. Mandatory Representation by the lawyer is a special form of procuration by the lawyer, German .etc prescribe it in the civil procedure law, thereby form out the system of Mandatory Representation by the lawyer. It refers that in the certain area of civil action, when the parties or their legal representatives on the lawsuit, they must entrust lawyer to complete the lawsuit behavior.The author analysis the system of Mandatory Representation by the lawyer from the legal philosophic perspective, that is, restriction of freedom for freedom, procedural justice, the promotion of law dialogue, the nature of civil procedure, then repeated its relations whit the lawsuit efficiency and the lawsuit cost from the economic perspective. We can found that "mandatory" is legitimate in Mandatory Representation by the lawyer, it can improve efficiency and reduce litigation costs.The author conduct the comparative research on the system of Mandatory Representation by the lawyer in different civil procedure model. We can found that in the Anglo-American model of the parties, the system of lawyer’s agene service is fairly complete, a high degree of reliance on lawyers. In the German and France model, many countries have implemented the system of Mandatory Representation by the lawyer , We can obtain a conclusion that ensure lawyer’s full agene service in civil action is common choice in the different civil procedure model.The introduction of Mandatory Representation by the lawyer is necessary, it meets the need of lawyer’s career development and civil legislation, adapt the complex trend of procedures and the demand for judicial reform. At the same time, the development of China’s rule of law, the legal profession increasingly mature and citizens awareness of law was strengthened, provide reference of feasibilities for the system. We should do our best to localize the mechanism of Mandatory Representation by the lawyer from the idea, the legislation, the system to safeguard, and play its unique value, make it become a promotive factor to harmonious society.更多还原
