【摘要】 循环农业作为一种新的农业经济发展模式,自其诞生以来,逐渐被实践证明是实现经济、环境和社会效益的有效途径。在我国发展农业循环经济有着重要的战略意义。但是我国的农业循环经济起步较晚,相应的法律政策制度保障也发展相对滞后,需要我们在结合我国农业循环经济立法的现状的基础上,进行有效的创新和完善。在依法治国的今天,法律的欠缺和不完善,无疑是新事物发展面临的一个主要问题之一。当前,我国的农业循环经济法律作为环境法的一个小分支,就象我国的农业循环经济一样,刚刚起步,或者立法方面存在着缺位和空白,无法可依;或者规定过于原则化,可操作性差;或者时过境迁,难以适应形势发展的需要;或者政府调整机制单一,刚性有余、弹性不足。这些缺陷的存在,限制了我国农业循环经济的正常有序发展。要克服农业循环经济发展中的制度性障碍,当务之急是在借鉴国外发展的成功经验基础上,结合本土特点,建立健全农业循环经济法律体系,体现循环发展的理念,并协调好与其他法律部门的关系,使我国的农业循环经济在立法上有所保障,有法可依;在执法层面上,要形成循环经济法的混合调整机制,继续强化行政强制的有效性,并着重完善经济刺激机制,大力引入行政指导机制等。守法上,要政府、企业和公众共同遵守相关的法律制度,合力推进农业循环经济的有效发展。此外,要从制度上积极构建发展农业循环经济的绿色技术支撑体系,从而形成一个有法可依、有法必依的良好的法制氛围。更多还原

【Abstract】 As a kind of new agricultural economy development mode, from its birth, is gradually practiced an effective way to realize economic, environment and social benefits. There is a important strategic sense develop the agriculture circulation economy in our country. But our country’s agricultural circulation economy start is late, the corresponding legal policy system safeguard also develops the relative lag, so it needs us to unify our country agriculture circulation economic legislation in the present situation foundation, carries on the effective innovation and the consummation.In today’s China which is governed by laws, the lack and imperfect of law has no doubt become one of the main problem that new things development face. Now days, as a branch of the environment Law, the situation of agricultural circulation economical law is just like circular economy itself, just started. Some of them have not been made and can’t be depended on; some of them are rigid in principle, lacking maneuverability; some of them are out-dated and hard to new situation; some of them are rigid but not flexible because of the mechanical governmental adjustment system. the existence of factor in system obstructed the normal development of agricultural circulation economy.To overcome the obstacles from system, the most pressing matter of the moment is to draw lessons from the successful experience of the other nations and build up sound Agricultural circular economy law system combined with a native characteristics, then make the principle of cicular development embodied in the law and moderate the relationship with other law sections. In the law enforcement stratification plane, we should from varied adjust mechanism , continue to enhance the effectiveness of administration compulsive mechanism and emphasize to pefect economy incitement mechanism, lead into the administration guidance mechanism.Obeys the law, the government, the enterprise and the public all should observes the related legal regime together, advances the agricultural circulation economy with joint forces the effective development. In addition, must construct the develop agriculture circulation economy positively from the system the green technology support system, thus forms one to have legal support, to have the good legal system atmosphere which the law must depend on.更多还原
