业主权纠纷类型及解决机制研究

【摘要】 我国小区中业主权益的保护一直缺乏有效、有力的法律规制,此次物权立法中虽规定了“业主的建筑物区分所有权”,但其内容原则而简单。反观其他国家和地区,均比较重视业主权、建筑物区分所有制度的立法,德、美、日、法等国家并据此形成了较为成熟的业主权利保护机制。本文采用系统研究、分析实证、比较研究、理论联系实际等方法,借鉴了法学、社会学、经济学、政治学等研究方法和研究成果。首先对业主权纠纷类型进行系统地阐释、界定,在此基础上,对业主权纠纷产生的原因,从业主权的立法不足、权力分布不对称、利益分配不平衡、主体观念及品行差别角度进行初步解析,继而,针对学界和实践中颇有争议的业主权纠纷中几个典型问题,结合新出台之《物权法》的对应规定,指出立法弊端的同时,通过相关案例进行说明分析。在此基础上,结合有关学术理论,提出一些具体的、有针对性的解决思路。最终试图从法理和法律制度的层面对业主权纠纷的消解提出对策和建议。本文分四章:第一章为业主权纠纷类型概述,分为业主权概述、业主权的相关利益主体、业主权纠纷主要类型三个部分;第二章为业主权纠纷的原因解析,有业主权的立法不足、权力分布不对称、利益分配不平衡、主体观念及品行差别;第三章为业主权纠纷中几个问题,涉及专有部分的相关争议、停车位、停车库的权属争议、成员权争议、物业服务中的纠纷;第四章为业主权纠纷的消解对策,提出完善业主权制度之我见、私权维护意识的养成及限度、行政权力的适当介入。

【Abstract】 In our state, community proprietor rights always lack of efficient and effective protections from legislations and regulations. Though the recent legislation of real rights prescribed categorized ownership of apartment house, its content is too simple and general. After going through systems in other states and regions, it was found that these states and regions paid much more attention to proprietor rights and categorized ownership of apartment house. In Germany, the United States, Japan and France, full-developed mechanisms for protecting proprietor rights have been achieved.Systematical research, empirical analysis, comparative study and actual cases of theory were used as research method in this article, which also used research methods and achievements from Jurisprudence, Sociology, Economics and Politic as references. Firstly, the article provided systematical interpretation and definition about types of conflicts of proprietor rights, based upon which, preliminary analysis about causes of conflicts of proprietor rights was made from perspectives of inadequate legislations for proprietor rights, asymmetry of power distribution, unbalance of benefit allocation, sense and morality differences of subjects. Then aiming at typical problems of debatable conflicts of proprietor rights on theories and practices, and combined with recently released regulations of Law of Real Right, it pointed out drawbacks of nowadays legislations by explanation and analysis about related cases. Based upon that, and combined with related theories and studies, it pointed out several concrete and pertinent thoughts for resolution. Finally, the article tried to offer recommendation and suggestions for resolving conflicts of proprietor rights from dimensions of law theories and systems.This article includes four parts: Chapter 1, description on types of conflicts of proprietor rights, which includes description of proprietor rights, related subjects of proprietor rights, and main types of conflict of proprietor rights. Chapter 2 is about analysis of causes of conflicts of proprietor rights, which includes deficiency of legislation, asymmetry of power distribution, unbalance of benefit allocation, and sense and morality differences of subjects. Chapter 3 was talking about several problems about conflicts of proprietor rights, including controversies of exclusive part, ownership of parking lot, rights of membership and conflicts in community service. Chapter 4 provides tragedies for resolving conflicts of proprietor rights, which points out the author’s opinion about improving proprietor rights system, developing sense of protection of private rights, and proper intervention of administrational power.
