秘密侦查制度研究

【摘要】 作为现代国家对抗特殊犯罪的新型侦查方式,秘密侦查的实践必要性及人权保护处于侦查理论、实践和立法工作的持续关注之中。本文的研究从秘密侦查的概念、起源与实践开始,进而阐述秘密侦查措施、秘密侦查的适用原则,最后将落脚点放在了我国秘密侦查的法治化上。第一章:“秘密侦查概述”。第一部分对秘密侦查概念进行了探讨,侧重于从程序和法律的视角界定秘密侦查的概念和要求。第二部分对秘密侦查之流变作出了系统考察,介绍、分析了中国秘密侦查发展简史、国外秘密侦查发展简史及当代秘密侦查的发展趋势,进而得出了“将秘密侦查纳入法治化轨道,是防止秘密侦查滥用的最有效手段”的结论。第二章:“秘密侦查与隐私权的关系”。第三章:“秘密侦查制度下的证据问题”第四章:“我国秘密侦查的法治化”。本章内容分为四个部分。第一部分阐述了秘密侦查的立法模式、法律要件及法律规则的设置等秘密侦查法治化的基本理论。第二部分从立法及实务现状入手,论述了我国现行秘密侦查的制度缺失及其不利影响。第三部分论述了我国秘密侦查法治化的基本路径及秘密侦查法治化的可行性及其制约因素。第四部分则具体提出了我国秘密侦查制度的总体立法构想及相关制度的具体架构。更多还原

【Abstract】 As a new policing method against the special crimes in the modern countries, the practical necessicty and human rights protection of the underwear policing has always been the focus of the policing theory, practicing and legalization working. The wirter begins from the conception, origin and practice to the practical methods, the legitimacy foundation and principles and finally focuses on the systematic legalization in China.The first section is about the sumary fo underwear policing. The first part discusses the conception and requirements of underwear policing from angles of procedure and legislation. The second part, reviews the trend of underwear policing, introduces and analyzes its domestic and foreign history and contemporary development, and finally comes to the conclusion that the most effective method to prevent the misuse of the underwear policing is to legalize its system. is about the legalization of underwear policing in China. The second section is discusses the regulationes between the underwear policing and human privacy. The third section discusses the envidences system under the underwear policing. The forth section is composed of four parts. The first part demonstrates the elementary theory for the underwear policying’s legalization, such as the legislation formula, legal requirements and regulations. The second part begins with the legal and practical situation to demonstrate the contemporary systematic blank and disadvantages. The third part discusses the basic approaches, the practicability and restrictions.
