我国城市房地产业相关环境问题及法律对策研究

【摘要】 城市房地产业在我国经济发展中占有日益重要的地位,带动了不下五十个相关产业的发展。从某种程度上来说,房地产业是中国当前的支柱性产业,也是实现“十一五”规划的重要前提。我国正处于全面建设小康社会,加速城市化进程的关键时期,满足人民日益增长的住房需求是其中一个重要方面。“居者有其房”是居住权的重要体现,也是人权(生存权)的重要内容。近年来,我国政府更是采取一系列措施稳定房价,并通过建设廉租房、经济适用房等形式保障公民的居住权,可以预见在我国作为房地产业重要一环的住宅产业在未来一二十年具有强劲的发展势头。在经济快速发展的大形势下,我国环境质量整体下降、资源严重不足,房地产作为高耗能产业,在其快速发展为世人瞩目的同时,其粗放式开发模式所带来的环境问题也日益凸显。高消耗、高排放、高污染、低效益的问题同样存在于房地产业。建筑能源消耗占人类社会能源总消耗的1/3左右。我国城市房地产业的高速发展,对环境保护、资源利用、能源供给方面的压力日益增加。建筑活动在人类实现可持续发展进程方面起着至关重要的作用。因此研究房地产业对环境的影响并在法律层面上提出对策具有重要的现实意义。文章从我国城市房地产业发展的现状着手,对其生产和消费领域存在的环境问题进行分析,同时借鉴国外关于房地产业环境立法的先进经验和发展趋势,提出完善我国房地产业环境立法的建议。首先阐述我国房地产业存在的环境问题,介绍了房地产业的定义,对房地产业环境问题的理论依据及其主要表现进行了分析;其次评析国内外应对房地产业环境问题的立法与实践;最后结合以上分析提出我国应对城市房地产业环境问题的法律对策。

【Abstract】 The real estate industry in China occupies an increasingly important economic position,led no fewer than 50 relevant industries development. To some extent,China’s real estate industry is the current pillar industry,but also an important premise for the 11th Five-Year Plan.China is in the critical period of building a comprehensive well-off society and accelerating the process of urbanization.Meet the people’s increasing demand for housing is one of the important aspects."Home Ownership has its housing" is an important embodiment in the right of abode.With the development of economy,recent years,our government is taking a series of measures to stabilize price,and through the construction of low-rent housing,economic and other forms of protection to the abode right of the citizen.It can be foreseen,China’s real estate industry as an important part of the housing industry in the next one or two decades,will have strong development momentum.Under the situation of economic quickly development,whole environment quality descends,and a serious shortage of resources.Real estate as a high-energy-consuming industries,Its extensive development model by the environmental issue has become increasingly prominent。At the same time, there are also many issues about high consuming,high letting,high pollution and low benefit in this industry.Energy consuming in construction occupies 1/3 of the total energy consuming of human society. Developing at high speed in our country adds pressure increasely on environmental protection,resource utilizing and energy providing. Construction activity not only has huge effect on human natural resource and surrounding,but also plays a key role at the process of realizing human continuable development,because of its universality and indispensab ility to people.Thus,study the influence of real estate to environment,and advancing some countermeasure on the law aspect has important realistic meanings.Beginning with the status of the development of China’s real estate, this thesis attempts to analyze the environmental problems on the area of production and consumption in China’s real estate industry,evaluate foreign environmental legislation experience and the advanced development trend on the real estate,and the same time make some suggestions to improve the legislation on environment law in the real estate industry. The thesis is composed of four parts:the first part introduces the environment problems of the China’s real estate industry,the definition of real estate,analysis environment problems on the real estate industry and the theoretical basis for a major performance;the second part introduce and analyze environment problems legislation and practice of the real estate in home and abroad.The last part makes some specific suggestions to improve the environment law in China.
