【摘要】 本文将自诉向公诉的转化作为研究、阐述对象。主要涉及的是自诉与公诉的关系及其追诉权分配的立法模式、自诉转公诉制度的含义、适用范围及其理论与实践依据、自诉转公诉制度的存在弊端及原因分析、自诉转公诉制度的完善等四个方面,并就相应问题提出具体的观点和建议。笔者,首先通过对自诉与公诉的关系以及两种追诉模式的介绍引出本文的研究对象;其次在对自诉转公诉制度的含义进行界定的基础上,介绍、总结我国自诉转公诉的范围及条件,并进一步分析了自诉转公诉的原因,指出这种转化是有着其深厚的理论依据和丰富的实践依据的;第三,接着本文又着重对我国自诉转公诉制度在实践和立法中表现出来的问题和原因进行了阐述,从而达到对我国自诉转公诉制度进行全面了解的目的。最后,针对我国自诉转公诉出现的问题,本文从原则、范围、程序、救济等方面提出个人的完善设想,以使该制度更具有合理性和可操作性。本文共分四章,近三万字,勾勒了自诉转公诉涉及到的主要问题。全文围绕自诉转公诉这一主题,提出了自己的学术主张,法理探讨与实践联系紧密,对制度完善与实践具有一定的参考价值。更多还原

【Abstract】 This article focuses on the transition from private prosecution to public prosecution. It mainly concerns the relationship between private prosecution and public prosecution, the legislative model of prosecution power allocation, the meanings, application scope, theoretical and practical basis, disadvantage and causes and improvement of this system named transition from private prosecution to public prosecution. Correspondently, I put forward some concrete opinions and suggestions.Specifically, first, I put forward the subject of study of this paper by introduction of the relationship between private prosecution and public prosecution and the two prosecution models. Secondly, on the basis of defining the meanings of transition from private prosecution to public prosecution system, I made an introduction and conclusion of the application scope and qualification of this system, and further more analyzed the causes of this transition and then pointed out that this transition had its profound theoretical basis and abundant practical basis. Thirdly, in order to understand this system thoroughly, I emphasized on the problems and causes of this system both in practice and legislation field. At last, in allusion to the problems of this system in China, I put forward my own improvement idea in principle, scope, procedure, relief perspectives, thus this system will become more reasonable and practicable.This article is formed of four chapters , and nearly 30,000 characters and discusses the main issues of transition from private prosecution to public prosecution. In this article, I put forward my own academic pinions and integrated theory with practice. Therefore, it has some relevance value in improvement and practice of this system.更多还原
