【摘要】 随着我国改革开放的不断深入与市场经济的蓬勃发展,私益保护受到深度重视,相对的公共利益却存在受到侵害而无从救济的现象。在生产力极度发展的当代,作为解决群体性纠纷的机制,针对公共利益侵害的民事公益诉讼的确立已到了迫在眉睫的地步。学界对于公益诉讼的研究,重心落在行政法学方向,对于民事公益诉讼的研究还比较薄弱。本文分为四个部分,分别从不同角度研究公益诉讼:第一部分:导论。描述当前公共利益受侵害的现状,得出公益诉讼的必要性。第二部分:公益诉讼。分析公益诉讼的基本理论,包括其概念、价值、特征及类型。第三部分:各国民事公益诉讼比较。比较分析各发达法治国家对于公益诉讼的立法规定,总结各国公益诉讼的基点,归纳其中共性和差异,形成对我国构件公益诉讼制度的借鉴。第四部分:我国民事公益诉讼实证分析及完善思考。立足我国现实状况、法律传统和司法实务,作出构建本国公益诉讼制度的尝试。更多还原

【Abstract】 With China’s reform, opening up and the constant deepening of the market economy to flourish, depth for personal interest to be protected, compared to the public interest, there are no violations of relief from the phenomenon.
