公司、企业人员受贿罪客观方面研究

The Impersonal Aspect of the Bribery of Personnel in Corporation

【摘要】 由于立法上的缺陷,公司、企业人员受贿罪在理论、实践上仍有较多分歧和争议,本文主要是从公司、企业人员受贿罪的客观方面进行阐述。首先介绍了公司、企业人员受贿罪的立法沿革;然后研究了本罪“贿赂”的内容范围,以及馈赠行为的认定;接着论述了“利用职务上的便利”的含义和时限;又分析了本罪的具体实施行为的二个方面,即索取他人财物或者非法收受他人财物的表现形式,实践中一些具体行为的认定;再对“为他人谋取利益”是否应成为本罪的构成要件作了探讨;最后提出完善本罪在客观方面的立法建议,包括扩大贿赂的内容、协调与受贿罪方面不一致之处、取消“为他人谋取利益”。

【Abstract】 Because of the defects of the legislation there are still some divarications in the theory and practice of the bribery of personnel in corporation. The paper will mainly expatiate the impersonal aspect of the bribery of personnel in corporation. First, it will introduce the legislative evolution of the bribery of personnel in corporation. Then it will dissertate in this accusation the connotation of the word‘bribery’and the cognizance of the presentation. After that it will expatiate the connotation and the time limit of making use of the functionary advantage. The cognizance of the two idiographic behavior which is to come down on others’lucre or to accept others’lucre illegally in practice will be discussed. After the analysis of some views on whether‘to figure for others’illegal interest’should be the important composing aspect of the accusation, the negative conclusion will be elicited. At last, the legislative suggestion to improve the accusation in idiographic aspect, including to expand the content of the bribery, to harmonize the disaccord of this accusation and the bribery and to cancel‘to figure for others’interest from the important composing aspect.
