信息产品责任问题研究

【摘要】 信息产品是以有形物质载体为表现形式,以公民、法人及其他组织对自然界与人类社会存在的事实与变化进行加工和创造而形成的各种信息为主要(核心)内容的,以经济交换为目的的产品。信息产品是以满足人们的信息需求为主的产品,包括出版物、广播电视、数据库,计算机软件以及互联网等各种不同类型。信息产品责任是信息产品存在质量缺陷,导致损害发生,从而应承担的一种法律责任。判断信息产品质量是否存在缺陷有五个标准:真实性、准确性、明确性、及时性、安全性。承担信息产品责任的主体可分为两类,一是无形信息的创制人;二是将信息附着于一定载体形成有形信息产品的制作人。对前者应适用严格责任,而对后者则适用过错责任。当然也必须规定一些抗辩事由,以免阻碍信息流通。

【Abstract】 Information products are those products carried by material articles for aims of exchange. The content of Information products is information of ex-istence and change of nature and society, which has been processed and cre-ated by citizens, artificial persons and other organizations. Information prod-ucts are products aimed for the information demand. Information products commonly consist of publications, broadcasting, television, database, com-puter software and internet, and so on. Liabilities of information products are charged with defect in quality of information products which induced dam-ages. The defect of information products is influenced by five factors: authen-ticity, veracity, definitude, timing and safety. The main body which brings on defect can be classed into two parts: one is the creator of the immateriality information; the other is the producer of the tangible information products. The strict-liability rule is applied to the former, and the fault-liability the latter. Of course, demurrer reasons are important to prescribe to the promotion of information-circulating.
