【摘要】 2007年《中华人民共和国物权法》明确规定了不动产物权的登记制度,虽然将不动产登记制度作为物权法的一项制度内容,但是,由于不动产登记的实质是国家公权力对物权设立及变动的干预,因而,不动产登记就不仅仅是一项民事法律制度,它涉及到行政权的运用和行使,再一次证明了法律部门之间存在着统一性和横向联系性。本文运用了比较分析的方法,围绕着不动产登记行为的性质这个中心问题,对不动产登记的法律属性、审查模式、责任归属等相关行政法问题进行探讨并期望能为我国不动产登记立法提供理论参考。更多还原

【Abstract】 In 2007, "People’s Republic of China Property Law" clearly regulates the system of the registration of the real estate property rights,Although the system of the registration of the real estate property rights is a content of the property rights law, the nature of the registration of the real estate is the intervention of the state public power towards the establishment and change of the teal estate property rights, so the registration of the real estate is not only a civil law system, It concerns the exercise and exertion of the executive power, and testifies the nature of the oneness and the horizontal linkage among the legal departmens again.The article exercises the method of the comparative analysis, surrounding the central issue of the nature of the registration action of the real estate, for discussing the legal attribute, the review model, the liability attribution and etc. relevant administrative issue of the registration of the real estate, and expecting for our country’s legislation of the registration of the real estate providing the theoretical reference.更多还原
