【摘要】 立法听证制度在西方国家已经有几十年的历史,而我国在实践和理论研究方面都还处于探索阶段。在我国走向社会主义法治国家的过程中,立法规模空前发展,立法的质量显的尤为重要。立法听证是从外国引进的程序制度,这一制度在我国不断走向民主法治的进程中必将得到充分的重视,因此在我国完善立法听证具有极其重要的意义,我国现阶段的立法听证从地方人大到全国人大都进行了一定的实践,实践中取得了一定的经验和成绩,但是由于历史、文化、民众心理和制度方面的原因,立法听证在实践中存在着一些问题。文章从听证起源和历史沿革出发,对我国立法听证实践作了概述,并对相关个案进行分析比较,指出了我国立法听证实践中存在的问题,针对这些问题提出解决建议。更多还原

【Abstract】 Legislation hearing system has already had the history for several decades in the western nation, but our country’s study aspects are still placed in a stage of the fulfillment and the theories. In our country, the alignment of the process of socialism country is under the rule of law and the unprecedented development of the lawmaking scale, lawmaking of the quality is importance. The lawmaking by listening to the government is from abroad usher of procedure system, this system necessarily will get a full value in the country’s continuously alignment of the progress of democracy rule of law, so listening to our country perfect lawmaking the certificate have very and important meaning, our country’s lawmaking in present stage by listening to a certificate greatly arrives National Peoples Congress to all carrying on certain fulfillment from person in the place, practice in obtained certain experience and result, but because of history, culture, people’s mental state and the reason of the system, the lawmaking by listening to the certificate existing some problems in the fulfillment.
