【摘要】 律师收费制度是律师制度中一个重要组成部分,涉及到律师与当事人之间的关系,律师在社会中的角色形象,律师及律师职业自身的生存与发展等重大课题。律师收费制度的科学合理与否,还关系到公民合法权益的维护水平,关系到社会正义与法律秩序的维护。笔者从事律师工作多年,一直希望结合自己的工作实践在理论上对此进行一定的梳理。本文第一章通过分析我国律师职业的属性、介绍新中国成立以来我国律师收费制度的历史变迁、分析律师收费制度的经济价值和社会价值等方面,对我国律师收费制度进行了概述。第二章通过对律师收费方式、收费标准以及促使律师收费制度趋向合理化的两个相关问题的阐述,分析了影响律师收费制度科学合理的因素,讨论了我国律师收费制度的合理化选择。接下来本文分四章,分别从建立以协商收费为主导的律师收费制度、完善我国律师风险代理制度、确立我国律师费用转付制度的必要性、健全我国律师收费争议处理机制四个专题,探讨了如何构建与完善我国的律师收费制度。希望本文的撰写能起到一定的抛砖引玉作用,引起理论界和律师同行们更加重视我国律师收费制度的发展完善。更多还原

【Abstract】 The Lawyer’s service charge system is a very important part of the whole legal system ,involving the realationship between lawyers and clients ,the social reputation of lawyers and the development of the lawyer as a profession.The first chapter of this thesis displays the nature and the history of the lawyer profession ,at the same time analyses its economic and social value ,and also gives a brief introduction of the service charge system. The second charpter mainly deals in the mode and standards of service charge,on the basis which makes a analysis of factors that affect the service charge system.The following four chapters focus on the bellowing topics:service charge system on discussion basis,peril agency,the necessity of setting up payment transfer and the establishment of dispute---settlement mechanism.I hope that this thesis could draw some attention of the scholars and my colleagues to the perfection of the Lawyer’s service charge system.更多还原
