中国古代刑事侦查制度特点研究

【摘要】 中国古代刑事侦查制度属于古代刑事法规体系中的一部分,是一个特殊的领域,虽然没有自成体系,包含于司法制度之中,但前人在侦查技术上取得的一个又一个辉煌成就,在侦查理论上所形成的许多策略、方法和原则,对于现实的侦查实践活动依然有着指导作用和借鉴意义。我国现代的刑事侦查制度存在着一些弊端,几经改革,在侦查实践中仍未得到彻底解决,究其原因,除了法制需要进一步健全,侦查人员的素质需要提高外,重要的是要从根源上,也就是历史上找原因,现代侦查制度存在的问题有些就是历史在延续。本文通过系统的梳理中国古代刑事侦查制度的内容,归纳中国古代刑事侦查制度的特点,剖析这些特点形成的原因及价值取向,并反思这些特点给当今刑事侦查制度带来的严重影响,期望中国古代刑事侦查制度中合理的思想和做法,可以为今日完善刑事侦查制度所借鉴。
【Abstract】 Chinese ancient criminal detection system which belongs to a part of ancient criminal law system,is a special area. Although it has no ready-made systems, included in the judicial system, the predecessors have made one after another brilliant achievements in this area and have formed many theoretical strategies, methods and principles which still have the instruction and the model significance to reality detection practice. Our modern criminal detection system has some drawbacks. After several reformations, the problems have not been completely resolved in the practice of the investigation. Apart from the needs to further improve the legal system and the quality of the investigation people, the important reason is from the roots, that is to say, the history reason. Some problems in the modern detection system are the continued questions of the history .This paper will pack up the contents of Ancient Chinese criminal detection system, Induce the characteristic of the Chinese ancient criminal detection system, Analyzes the reason of these characteristics, and reconsider the serious influence of these characteristics on the modern criminal detection system.. We expect the reasonable ideas and methods in the Chinese ancient criminal detection system will give a reference to consummate the modern criminal detection system.
