中国古代监察权力控制机制的当代借鉴

【摘要】 中国古代监察制度作为封建社会政治制度的重要组成部分,在维护皇权和君主专制统治中发挥了巨大的作用,其制度的严密为中外政治家、学者所瞩目。而在中国封建社会的监察制度的体系中,对监察权力控制的有效机制更是其它封建国家无与伦比的。本文从中国古代监察权力控制机制这一特定层面入手,对中国古代监察制度中控权机制的形成、发展、完备的过程进行了分析;对其有效的控权措施进行了的研究;对其控权的法律制度规定进行了挖掘;对监察权力控制机制的特点与局限性进行了研究,试图通过对古代监督权控制机制中有益于当代借鉴的分析思考,为现阶段公安机关推行依法行政,防范行政权力滥用,建立与当前国情相适应的行之有效的警务监督机制,并发挥好警务监督机构和人员的职能作用,提供理论支持及实施操作的可行性方案。更多还原

【Abstract】 As an important part of feudal social political system, the Chinese ancient supervisory system has been paid attention by politician and scholar from china and foreign countries because it played a significant role in strengthening empire reign and maintaining feudal centralization of powers, particularly it formed a set of effective institution mechanism and supervision statues control, it is unique comparing with foreign feudal countries.From the particular angle of supervisory power control mechanism, this dissertation analyzed the procedures that the Chinese ancient supervisory system had been formed, and studied its effective characteristic of supervisory organization structure, operating mode of statutory authority, virtues and limits of the Chinese ancient supervisory system, and control of supervisory system authority in ancient China, Moreover explored and summarized the successful experience of ancient times and modern times supervisory system , so as to provide theoretical basis and operative program to how to form useful police supervisory mechanism and excel the virtue of police supervisory authority including police duty .更多还原
