【摘要】 随着高等教育的发展,高校学生的人数急剧增加,如何对学生进行管理成为学校工作的重要内容。本文分四部分进行高校学生人身伤害事故的法律思考。第一部分界定高校学生人身伤害事故的定义,并分析其特点。第二部分分析高校学生人身伤害事故现状,将伤害事故分为第三人侵权行为导致的;学校教学设施、生活设施导致的;学生参加的校内集体活动导致的;在校生因学校提供食物、药品引发的;在校生因突发性疾病、严重疾病及猝死引发的;在校生在实习中发生的;学生因自杀、自残导致的;校外发生的和在校意外事件导致的人身伤害事故这样九类。第三部分根据事故的分类,每类选择一至两个典型案例,对高校学生伤害事故法律责任认定中的难点进行分析:高校和大学生的法律关系;高校承担责任的过错认定;不同事故类型高校免责的条件;高校体育运动伤害公平责任原则的运用;特异体质学生人身伤害高校责任承担;对实习学生人身伤害事故的责任承担。通过对难点的分析,明确责任承担的法律依据。第四部分分别从立法、学校管理和社会保险制度角度提出人身伤害事故的防范和处理策略。更多还原

【Abstract】 Along with the development of higher education, the number of the higher schools’ students is increasing rapidly. So how to manage the students become an important content of the school employment. This thesis is divided into four parts to consider the high school students’ personal injury accidents from legal aspect. The first part defines the high school students’ personal injury accidents, and analyzes its characters. The second part analyzes the actuality of the high school students’ personal injury accidents. The injury accidents can be induced by the infringe behavior of the third people; or by the teaching establishment and living establishment in the school; or by the schools’ collectivity movement that students take part in; or by the food and medicine that the schools provide to the students who live in them; or by the students in schools who have paroxysmal disease, serious disease and sudden death; or by the students who is in the process of practice; or by the students who suicide and self-injure; or the personal injury accidents that coursed by accidents happened in and outside school such nine sorts. Bases on the sorts of the accidents, the third part chooses one or two typical cases for every sort to analyze the difficulties in the cognizance of the legal responsibility, such as the legal relationship between the college and the college students; the cognizance of the fault that schools should respond; the different type of accidents that the colleges can duty-relief; the exertion of the equitable liability principle in high school athletic sports; the liability of the special constitution students’ personal injury accidents that the schools should assume; the personal injury accidents of the students who are at practice that the schools should assume. From the analyze of the difficulties, we can define the legislative authority of the liability that the school should assume. The forth part puts forward the defense and disposal policy for the personal injury accidents from the angle of lawmaking, schools’ manage and system of the social insurance.更多还原
