【摘要】 农地征收是加快推进现阶段我国农村城市化进程、扩大城市化规模的重要途径。农地征收涉及到国家、用地单位、农民集体和农民个人多个权利主体的利益,体现了土地权利在不同主体之间的分割与变换,是土地产权在经济上得以实现的一种特殊方式,因此必须正确处理好各权利主体之间的经济利益关系,既防止政府滥用征收权,又避免农民土地权益受到侵害。目前我国土地征收中存在农地无序征收现象和被征地农民利益被侵害现象严重的问题。这些问题造成了土地资源的不合理占用和浪费,加剧两了极分化和农民贫困,引发了各种社会矛盾,同时也造成了巨大的社会成本和政治成本。农地征收问题的严峻性使之成为社会各界广为关注的焦点、讨论的热点及改革完善的难点。究其原因,主要有农地征收法律制度存在缺陷、政府的行为失范及缺乏农地征收的有效监督和公平裁决机制几个方面。为此本文从以下几个方面提出了解决问题的相关建议:1、完善农地征收制度;2、转变政府职能;3、建立有效的约束机制;4、健全和完善农地征收监督机制。更多还原

【Abstract】 Rural collective land expropriation is a major step in the course of promoting rural urbanization and expanding urbanization.As one special way which can realize the land property right in the economy,it involves the benefit of the nation,the land unit and the peasant personally,and has manifested the division and the transformation of the land right between the different main body.Therefore we must process the economic interest relations between various subjects of object correctly,both preventing the government to abuse the expropriation power,and avoiding the violation of the rural collective land expropriates’ legitimate rights and interests.In the present the disorder expropriation of the rural collective land seriously issues as well as the infringements of rural collective land expropriates’ legitimate rights in our country.Which have caused a waste and unreasonable use of the land resource,the polarization and all kinds of society contradictory,simultaneously has also created the huge social cost and the political cost. The existing problems of Chinese rural collective land expropriation has become focal point,discussing hotspot and difficulty of policy reform and consummation,which all social circles pay attention to widely.The deep-seated reasons for such issues lie in the following aspects.The unsound and incomplete institutions with regard to the rural collective land turn out to be the essential factors.Government wise,the government doesn’t exercise its administration according to the law,which makes it malfunction and role-clash with the peasants.Meanwhile the lack of oversight and ruling also proves to be another important cause.So countermeasures are proposed,including the perfection of legislation,the transformation of government functions,and the strengthening of the legal enforcement,the establishment of oversight and restrain mechanism.更多还原
