【摘要】 环境行政不仅是一个决策和执行的“事实领域”,它也是一个哲理和道德的“价值领域”。本文撰写将以环境行政“价值领域”为基点,从伦理学为视角审视环境行政人员的道德责任。论文主要分为四大部分:第一,分析了环境行政人员与道德责任的关系问题。论述此部分的目的就在于为研究环境行政人员的道德责任研究打下理论铺垫。第二,以行政伦理学的理论为基础,从环境行政人员的道德责任划分入手,探讨环境行政人员道德责任,并归纳了环境行政人员道德责任的特点。笔者将从义务型和理想型道德责任入手来探讨环境行政人员应承担的道德责任,并在此基础上归纳出环境行政人员道德责任的特点。第三,分析了影响环境行政人员实现道德责任的主客观障碍。笔者认为,影响环境行政人员实现道德责任的主观障碍有三点:价值观取向上的困惑、道德责任承担上的冲突和“公共性”与“私人性”的对立。影响环境行政人员实现道德责任的客观障碍也有四点:社会环境法治传统淡薄、市场经济发展中问题凸现、环境行政执行权责不明和环境行政监督力度不够。第四,针对环境行政人员道德责任实现的主客观障碍,提出了几点环境行政人员应该树立的主要原则以及实现道德责任的途径。这些原则包括:伦理自主的原则、环境公正的原则、尊重生态规律的原则和生态环境可持续发展的原则。实现的途径主要有:①加强环境行政人员的行政和环境伦理教育;②强调自律,注重自我关注和自我实现;③重视环境行政中的伦理法律构建─强化伦理约束力;④改革环境行政执行体制,明确环境行政部门权限;⑤建立环境行政的制约与激励机制。更多还原

【Abstract】 Environment administration is not only a“fact field”on decision-making and execution, but also a“value field”on philosophy and ethics. This paper will take“value field”as its foundation so as to make a devotion to the development of our national environment administration theory. This paper will be divided into four parts:Firstly, this paper clarifies what the moral responsibility is and analyzes the relationship between public administration, public administration officials and moral responsibility. The aim to this part is for the theory foundation for moral responsibility on public environment administration.Secondly, this paper will discuss different kinds of moral responsibilities and analyze the characteristics of moral responsibility on environment administration officials. The author will discuss the moral responsibility though the division of obligation and ideal, and sum up the characteristics of their moral responsibility.Thirdly, this paper analyzes the main bewilderments and objective obstacles that environment administration officials may have. The bewilderments are: role bewilderment、object bewilderment and gist bewilderment; The obstacles are four points: social environment protection consciousness is weak、social market economy is immature、the environment administration is incomplete and environment execution supervision is difficult.Lastly, for the bewilderments and obstacles, this paper provides us this some main ideas and ways to make their moral responsibility come true. Those ideas are:“justice”、“sustainable development”、“ethic self-control”and“respecting ecological rules”. The ways are:①enhancing their administration and environment ethic education;②making environment administration laws so as to strengthen the ethical sanction;③reform the system on environment administration execution, and certify the authority of environment administration sections;④build restriction and inspiration systems on environment administration execution;⑤enhance self-control and pay much attention to self-realization and self-care.更多还原
