【摘要】 近年来,随着我国改革开放的顺利推进以及加入世贸组织对我国经济开放的促进作用日益显现,市场经济体制度在实践中得以不断完善,我国经济领域对外开放程度也越来越宽广。为了更好的推广我国的对外经济贸易活动,作为促进国际贸易交往的仲裁服务也日渐发展壮大起来,仲裁机构的程序及制度也更加重视当事人的意思自治,使当事人在商事活动中拥有更大的选择空间。仲裁程序的架构对于保障仲裁实体法律关系的良性运作影响深远,由于仲裁制度的原型来自国外,就我国目前的仲裁程序整体设计而言,尚有部分环节不尽完善。为了能够更好的表现和弘扬仲裁公正、效率以及意思自治等理念,本文以仲裁程序的整个动态运行为基本线索,将仲裁的基本理念贯彻其中,对我国现行仲裁程序设计中的若干瑕疵予以检讨并提出完善之道,努力探寻更加符合我国国情及法律体系的仲裁制度。更多还原
