建设工程(施工)合同管理的应用研究

【摘要】 本文从承包企业方出发,以施工合同管理工作的主要内容为基础,结合合同管理生命期的特点,对施工合同管理工作的内容与方法进行了深入研究。在文中主要涉及的研究工作有:(1)结合国际常用施工条件指出我国合同管理工作现存的缺点,找出根源,以便更好的找出完善我国合同管理工作的方法。(2)划分施工合同的生命期,使施工合同管理工作的边界更加清晰、明朗,并在这个基础上指出施工企业进行合同管理工作的内容,包括施工合同文件的范围,我国常用施工合同的主要条款。(3)施工承包企业从工程投标阶段介入到工程之中,招投标文件也是合同文件的重要部分,文章对投标工作进行了系统的总结,以帮助施工企业能顺利夺标。在夺标后又对双方合同条款谈判内容进行了叙述。成本、质量和工期是合同中规定的三大目标,是合同管理工作的核心,本文对质量、工期和成本在施工中的控制原则与内容进行总结,从而更加完善施工合同管理工作。(4)风险管理是合同管理的一个重要部分,认真做好风险管理工作有助于施工企业取得更好的经济效益。本文在对施工合同的风险种类进行总结之后,运用了一些方法,如专家调查法,财务报表法等对风险进行识别,从而提出合同风险的一些防范手段。最后,为了更好的对施工合同和合同风险进行管理,又提出了几种有效的施工企业合同管理机构。(5)因为合同管理工作是一个经验性很强的工作,本文在系统地将施工企业的合同管理工作内容和方法进行总结之后,采用模糊层次分析法对管理效果进行了综合评价。从而为企业的合同管理工作积累经验。

【Abstract】 This article from the perspective of the contracting companies,and it based on the main elements of construction contract management, it combines life of the contract management features,and do an in-depth study to construction contract management of the content and methods.The main study of the text are:(1) The article integrated with the international common conditions to find out the Chinese Construction contract management of the existing shortcomings, find out root causes, for better identify the work of improving our contract management approach.(2) The article divided the life of the contract period, then the boundary of the construction contract management more clearly and uncertainty, and on this basis point out the construction enterprise contract management work, including construction of the scope of the contract documents, commonly used in Chinese major construction contract terms.(3) Construction contracting companies involved in the engineering works from the tendering stage,the bidding documents are also an important part of the contract documents, the articles summing up the tender work systemly, and for some bidding strategies and skills to help construction companies to Smooth championship. In the championship after the owners and the construction side in the negotiations on the terms of the contract made a number of common strategies and techniques. Cost, quality and construction period is three major objectives in the contract, It is the core management of the contract, It make a systemly summary to the construction enterprise of contract management of the content and methods, So as to better management of the construction contract.(4) Risk management is an important part of the contract management. do a good job in risk management of construction enterprises to get more economic returns. In this paper, the construction contract summary the types of risks, and use of a number of methods, such as expert investigation, the financial statements and so on,then do the risk identification, It has made a number of preventive measures of the risk the contract. Finally, in order to do a good work to the construction contract and contract risk management, there is also several effective enterprise Contract Management agency for the contract management(5) Because the contract management is a very strong empirical work, the paper will be in the system and the construction enterprise contract management summary of the contents and methods, the use of FAHP effect on the management conducted a comprehensive evaluation. To the business of contract management of the accumulated experience.
