商品化权略论

【摘要】 在商品经济社会,可商品化的事物越来越多,如何认识这一现象,正确解决实践中发生的纠纷,法学界存在不同的意见。本文科学界定了商品化权的概念,采用新颖的定义方式,阐明了商品化权的内涵与外延,进一步明确了商品化权是一种新型的知识产权的基本属性。从理论上解决了商品化权在法律体系中的地位。从多角度、全方位、宽领域区分了商品化权与传统民法中的人格权、知识产权中的著作权、专利权、商标权、反不正当竞争权的不同,以及对我国相关法律中商品化权保护不够的原因进行了探究。在比较研究美国、日本、英国、德国等国外相关法律制度的基础上,借鉴国内法学界的研究成果,并参考众多国内外司法判例,提出了关于我国商品化权的立法建议,以期推动商品化权的立法进程。本文采用了比较分析方法、历史借鉴分析方法、法经济学方法、法解释学方法等科学研究方法。

【Abstract】 The thing can be merchandised more and more in society of commodity economy. How to know the phenomenon and solve the trouble in practice, there exists different opinions in law world. The article models scientifically the concept of Merchandising Right, and clarifies its internal and external content by new means. The article clears further its basic nature as new intellectual property and solves its status in law system. The article distinguishes it from personality of traditional civil, copyright, patent, trademark right and unfair competition law through different angle, aspect, and domain. The article discusses the reason of its insufficient protection in China law. The article put forward its legislative plan, to push ahead its course in China, by way of comparing the law of America, Japan, Britain and German, also through using the experience and case of other countries. The article applies scientific research methods of comparing analyze, drawing lessons from history, law economy research, explaining law.
