监企分开:监狱体制改革研究

【摘要】 中国监狱对服刑人员的改造主要是监管教育改造和劳动改造。监狱劳动改造的主要内容是组织服刑人员进行生产劳动。监狱通过自身的经营活动,把监狱劳动产品转化为社会需要的商品,从而实现其市场价值,而经营所得则直接用于弥补监狱经费的缺口。目前几乎所有中国监狱都兼备了监狱职能和企业职能,并将监狱和企业合为一体,形成了单组织多目标的管理模式。但是,随着我国社会主义市场经济体制的初步建立和社会主义市场体系的深入发展,这种监企合一的管理模式的运行矛盾逐步显现,甚至已经成为制约监狱职能发挥和效能提高的重大障碍。无论从监狱本来的职能的角度来看,还是从企业经营管理的角度来看,现行监企合一管理的模式都出现了与社会主义法治社会不匹配的现象。监狱效率问题引起了国家高层决策者改革监狱体制的决心。监狱体制改革主要意义就在于推进监狱管理法治化、科学化、社会化。现代监狱制度根据公共利益建立评价体系,适应社会发展和社会需求,彰显公共组织和经济组织在监狱管理中的积极作用。本文首先介绍了监狱体制改革的背景,当前监狱的结构现状是监企合一,监狱体制改革的出发点应当是改善其功能、完善其价值,从而决定其性质和结构。在新公共管理理论的基础上构建了监狱体制改革的理性分析框架,监狱体制改革是使监狱职能的回归,实行监企分开。通过对国外监狱现状的归纳,总结出一些值得借鉴的经验。从对现行监企合一体制的弊端的分析入手,分析当前监狱体系内的监狱职能和企业职能并重,两者的内在矛盾导致了监狱职能的错位;监狱的人事管理体制不顺;监狱的企业制度存在严重缺陷。分析了监狱体制改革的动因和监企分开的必要性,并通过对国内监狱实行监企分开试点的情况的研究总结出监企分开的具体措施。最后对监企分开后监狱和监狱企业如何发展提出了具体的对策。本文的创新之处在于提出解决服刑人员的强制劳动和劳动报酬问题是解决监企分开问题面临矛盾的一个关键。

【Abstract】 In Chinese prisons, the reclamation to the prisoners mainly includes supervision and laboring. The chief content of laboring reclamation is to organize the prisoners to work. The prisons convert the production to the commodity that the society needs through the management, which can actualize its market worth. The earning of management can make up the funs gap of prison directly. At present, almost all the Chinese prisons have both function of prison and enterprise which are combined together to form the management mode of single organization while multiple objects. But, with the primary foundation of our socialistic market economy system and deeper development of our socialistic market system, the management mode of combining the prison and enterprise has shown its running conflict gradually, and even becomes the great obstacle which restricts the exertion of prison function and improvement of efficiency. The current management mode of combining the prison and enterprise has appeared some phenomena that are not matching to the socialism rules society by law. The prison efficiency problem makes the decision-maker of our country decide to reform the prison system. The modern prison system, according to the public benefit, establishes the evaluation system to fit the development and requirement of society, which makes it prominent that public organization and economic organization play an active role in prison management.The thesis introduces the background of reforming the prison system firstly,the current structure is the mode of combining the prison and enterprise.The start of reforming the prison system should be improving its function, perfecting its value, after which its character and structure will be decided.Then analyzes the opposite and unitive relationship between prison function and enterprise function in current prison system according to the disadvantage of combining prison and enterprise, The inherent contradiction between the two led to a prison functions of the dislocation; prison personnel management system is not suitable; prison enterprise system existence serious defect. In the new public management theory was constructed on the basis of rational analysis of prison reform framework, reforming the prison system is the return of prison function, detaching the enterprise from the prison; then some experiences deserving to use for reference are summed up by concluding the foreign prison management system; then analyzes the necessity of detaching the enterprise from the prison, and summarizes the pilot situation of domestic prisons that have detached the enterprise from the prison. Finally, the thesis puts forward the detailed counter measures to how to develop the prison and its enterprise after detaching. The innovation of this thesis is to put forward that settling the prisoners’forced labor and laboring reward is the key contradiction of detaching the enterprise from the prison.
