【摘要】 我国建筑施工企业发展迅速,无论在数量和规模上都在日益扩大。合约管理在建筑施工企业中的地位逐步提高,合同方面的风险对其经济的影响也最大。本文以建筑施工企业为切入点,针对该类企业在合约管理方面的特征,分别从合约管理的前期、履行、总结、拖欠款的清理与回收、诉讼及案件处理五个阶段进行讨论,分析建筑施工企业在合同管理中存在的风险,并针对不同的风险提出解决方案。本文目的是寻找出一整套完整的、具有可操作性的合约风险管理方案,为我国建筑施工企业提供一套可借鉴的合约风险管理的经验及可查询的资料,尽量避免由于合约管理方面的问题而遭受毁灭性的打击,使企业能够得到顺利发展。更多还原

【Abstract】 In our country construction enterprises develop very fast. The firms expand gradually both in quantity and in dimensions. The status of contract management in construction enterprises enhance gradually. And the influence in contract risk is the best for its profits. So this article takes the construction enterprises as a breakthrough point, in view of this kind of enterprises’ contract management characteristics, discusses form five steps and conducts the research of the risk question which exists in the contract management. The five steps are prophase of contract management, period of contract perform, times of clear and take bake the arrearage, period of lawsuit and deal with the case. We analysis and discusses the construction enterprise’s risk which exists in the contract management, and has carried on the key discussion to the risks’ type and circumvention methods, attempts to discover the construction enterprise’s risk of the contract management to have a feasible plan, provides a model of the experience for our country’s construction enterprise’s development, avoids the ruinous attack by the time which suffers as a result of the issues of the contract, enables our country’s construction industry to be able to obtains the smooth development.更多还原
