论行政主体的自由裁量权及其控制

【摘要】 行政自由裁量权是社会历史发展的必然产物,是行政权中一项十分重要的权力,也是行政法的核心理论问题之一。行政自由裁量权是一把双刃剑:一方面它的运用可以提高行政效率,加强行政管理,给行政相对人带来福利;另一方面,实践中行政自由裁量权的滥用,又带来严重的负效应和弊端,极大地损害行政相对人的合法利益,滋生严重的行政腐败,影响国家的长治久安。如何对行政自由裁量权进行有效控制使其最大限度的服务于社会,成为现代行政法领域中一个非常重要的问题,也是本文所讨论的。本文从界定行政自由裁量权着手,对包括行政自由裁量权存在的基础、行政自由裁量权被滥用的可能性、滥用行政自由裁量权的主要形态、对行政自由裁量权程序性控制的理论及实践等在内的相关问题进行了探讨研究。文章采取理论分析和比较分析的方法,通过借鉴和比较国外的先进经验,来寻求对我国行政自由裁量权进行程序控制的有益启示。针对我国行政自由裁量权的现状与问题,本文提出了从完善行政立法、健全行政自我控制体系、改进司法审查等方面以完善我国从程序上对行政自由裁量权控制体系的构建。更多还原

【Abstract】 The inevitable result that the right of judging amount freely of the administration is social historical development, is a very important power in administrative power, it is one of the key theoretical questions in the administrative law too. Administrative Discretion is a double-edged sword: on one hand its application can enhance administrative efficiency, strengthen administrative management and benefit private parties a lot; on the other hand, the abuse of the administrative discretion in prance will bring serious negative effect. Its abuse would greatly damage legal interest of private parties and lead to serious administrative corruption. How to control the administrative discretion effectively to make it serve the society best has become a very important question in modern administrative law area and it is also the theme of this article.The meaning that this article judge’s quantity from the administration freely is set about, to including the necessity that the right of judging amount exists freely of the administration, possibility that the right of judging amount is abused freely of the administration, abuse administration cut out main shape to measure right freely, person who cut out theory and practice that right controlled relevant problems inclusive carry on discussion research freely to administration. Through comparing with the newly founding in western society, the instructive inspiration of how to control administrative discretion in China is to be sought out. In the light of the present situation and problems of the administrative discretion, the text put forward some ideas: perfecting the administrative legislation, strengthening the administrative self-control, improving the judicial control in order to perfect the design of it.更多还原
