【摘要】 随着《国务院关于加强国有土地资产管理的通知》、《国务院办公厅关于规范国有土地使用权出让收支管理的通知》以及国土资源部、财政部、中国人民银行于2007年11月19日《土地储备管理办法》等政策的出台,我国的土地储备制度得到了前所未有的规范,其中对土地的供应、出让、土地储备的计划、收购、开发、利用、储备土地的范围和程序都作了说明,为我国土地储备的实施起到了法律规范作用。但现有的法律法规中并没有对土地储备运作模式进行相关的说明,各地根据实际情况采用了不同的土地储备运作模式。本文在借鉴前人研究成果的基础上,通过对比分析国内外城市的土地储备运作模式,研究得出了我国土地储备应选择的运作模式。结合土地储备在大同市运作的情况,对大同市土地储备运作模式进行了重构。本文运用了社会调查、资料分析归纳、比照分析、文献研究的方法。本文在第一章介绍了选题背景、研究目的和意义、研究现状以及研究思路和方法。在第二章首先列举了土地储备和土地储备运作模式的定义,随后介绍了土地储备的理论依据:供求理论、市场失灵理论和政府经济学理论,并且提出了三种土地储备运作模式:政府主导型、市场主导型、政府市场结合型运作模式。在第三章里比较分析了国外的土地储备模式,然后对我国城市土地储备发展概况进行了介绍,随后对上海市场主导、杭州政府主导和武汉政府市场相结合的土地储备模式进行了比较分析。在第四章,对我国应选择哪种土地储备模式进行了研究。第五章对大同市的土地储备模式进行了研究,最后对大同市土地储备运作模式进行了重构:设计运用了依法性、系统性和循序渐进的原则,在此基础上完成了大同市土地储备运作模式的框架设计。本文通过对土地储备运作模式的研究,分析得出我国应采用政府市场相结合的土地储备运作模式,在制度方面要积极采用土地储备优先购买权,资金方面要实行多元化融资,同时应该采取土地储备委员会、土地储备中心、土地交易中心和土地公司相结合的机构设置模式。更多还原
