【摘要】 据国际权威机构Transparency International(透明国际)一项调查显示,时至目前,中国已成为世界上商业贿赂情况最为严重的国家之一。商业贿赂是一种腐蚀剂,是对市场经济和财富伦理的一种扭曲。别看商业贿赂四个字只关乎“商业”,其实商业所贿赂的是权力,已成为催生政府官员和工程项目业主腐败的影子杀手,已成为侵蚀行业行政主管部门个别领导干部“廉洁肌体”的“重症病毒”。不能想象,一个依靠商业贿赂发展壮大的企业,能打造出真实的竞争实力,一个漠视正常市场游戏规则的公司,能在国际市场上获得长远发展。工程建设行业商业贿赂是国家治理商业贿赂的重点领域之一。工程建设行业商业贿赂,是一个“欲说还休”的话题,因为它昭示出施工企业和行业从业者有太多的无奈,太多的隐痛,太多的不得已。从一个工程的招投标开始到工程的结算,商业贿赂存在于一个工程的各个环节之中。对于建设领域的商业贿赂其产生的原因是多方面的,其中包括体制上的原因,经济上的原因,社会层面的原因。然而,工程建设行业商业贿赂,又是一个不得不谈的话题,因为国家在行动,全社会在关注,行业在治理;小则影响企业的前程,大则影响行业的健康发展甚至于影响到国家的国际声誉和形象。对企业商业贿赂外部环境的治理,政府和社会起主要作用。加强思想道德的建设,夯实道德尤其是职业道德这个人文伦理基础。积极配合整个社会转型,完善各项法律法规制度,让招标投标过程公开化、透明化,加强执法力度,鼓励和发挥公众及媒体的监督作用。切实转变政府职能,在政府事务中大力制定和推行公开制度,让权力在阳光下运行,自觉接受公众和媒体的广泛监督。推进“同城合一”。对工程建设行业产生商业贿赂的内部管理的防范,企业起主导作用。企业内部的防范措施,应采取以制度促进规范发展;实施“阳光工程”;推行廉洁文化新模式等强化企业内部管理的有效手段;不断增强企业的竞争实力,让企业及职工追求和享受阳光下的最大利润。更多还原

【Abstract】 According to a survey from the authoritative international body Transparency International, at present, china has become one of the world’s most serious cases of commercial bribery country.Commercial bribery is a distorted to the market economy and wealth ethics. Commercial bribery is not only about commercial, it is about power. Commercial bribery has become the shadow killer of the government officials and project owners. It has become the severe virus that erosion individual industry administrative departments of leading cadres. We can not image an enterprise that develops relies on commercial bribery has real ability and gets longer development in the globe market.The construction industry is one of the key areas that government cares, because it shows a construction enterprise and industry practitioners too much frustration, too much pain, too much a last resort. From project bidding to the settlement, commercial bribery exists in a project among the various segments. There are many reasons about commercial bribery in construction industry, including institutional reasons, economic reasons and social dimension reasons.The construction industry commercial bribery is also a topic to talk about. Because country is in the action, the whole society is in the concern, industry governance. It not only has impact on the future of trade unions and the healthy development of the industry but also affects the country’s international reputation and image.Government and community play a major role on the governance of the external environment for commercial bribery. To strengthen ideological and moral construction, in particular, reinforce the moral ethics of this ethical foundation of the humanities. Actively cooperate with the whole community in transition, and improve the system of laws and regulations. Let bidding process is open, transparent, strengthen law enforcement efforts, and encourage the public and the media to play the supervisory role. Effectively change the functions of the government, to develop and implement an open system in the government affairs so that power can run under the sun, and consciously accept a wide range of public and media supervision. Enterprises play a leading role to the internal management of commercial bribery prevention. Internal preventive measures should be taken to standardize the system to promote development. Impel "Sunshine Project". The new model of honesty and cultural enterprises such as strengthening internal management of an effective means should be taken.
