不动产登记机关的赔偿责任

【摘要】 不动产物权登记是国家强化不动产管理,确认不动产物权归属最重要的根据,作为物权理论中一项重要的内容,具有维护不动产权利静态安全和保障不动产动态交易安全的功能。登记内容正确与否,不仅影响到交易当事人的利益,而且影响到交易的安全和秩序。登记机关违反登记过程中承担的义务,使公民的财产利益遭受损失的,理应赔偿。本文从理论分析入手,联系我国不动产登记法律制度的现状、结合案例,探讨不动产登记机关承担登记瑕疵的法律责任。全文除引言和结论部分外,分为五章,内容概要如下:第一章不动产登记的性质。分析登记行为的法律性质,明确登记行为兼备公、私法性质,且以私法性质为主;阐述登记行为有公法性质但并非行政管理行为。第二章不动产登记的机关。探讨承担赔偿责任的主体,主张建立统一的登记机关,以合并现有不同登记部门的方式,统一行使登记职权。第三章不动产登记的审查模式。确定登记机关的审查模式应采用实质审查主义,配合公证制度克服实质审查的缺陷。第四章不动产登记赔偿的认定。从赔偿性质,归责原则,救济程序三方面,明确登记错误赔偿不仅属于国家赔偿,而且本质属于侵权赔偿;在此基础上确定过错推定的归责原则,并适用民事诉讼程序获得救济。第五章设立赔偿基金和确立内部追偿的必要性。提出内外赔偿责任相结合,对外以赔偿基金形式减轻登记机关赔偿责任并弥补受害人损失;对内确立内部追偿制度补救登记机关的损失。

【Abstract】 Real property registration is the base for the government to enhance the supervision of property, and affirm the rights-belonging as well. Whether the registration is accurate or not will affect the profit of the two parties and the regulation of the trade safety as well. Therefore, if inexactitude is aroused by the registry agency, the registry agency should compensate for the losing.This article begins into five parts besides the foreword and conclusion.The first chapter analyzes the character of registration act. It should have the characteristic of public law and civil law.The second chapter deals with the registry agency. It will give out the design for a unified registry agency by unifying the real estate agency with land registration.The third chapter is the definition for the obligations of the registry agency. And we approve that the registry agency should take the essential examination pattern of registration with a remedy of notarization.The fourth chapter deals with the related issues of compensation from procedure, characters of compensation and responsibility principle.The fifth chapter discusses the compensation system and compensation fund.
