【摘要】 近年来,基因工程技术是生物学科中蓬勃发展的一个领域,通过基因工程技术获得的转基因制品也发展迅猛,而我国相应的立法则令人堪忧。公众对基因工程安全知之甚少,法律本身的疏漏和针对面的狭窄,执法、监督机构的不健全,使我国的基因工程安全立法远远落后于技术的发展,使基因工程技术发展无法可依。因而,健全我国的基因工程安全立法在当前具有必要性和紧迫性。本文围绕转基因技术及其制品的安全立法问题,对我国基因工程安全立法现状和美国、加拿大、欧盟、澳大利亚、日本等发达国家不同模式的法律法规进行比较分析,针对不足之处,对我国生物安全法律体系的完善提出了建议,以便使基因工程技术及其产品能在我国健康的发展。更多还原

【Abstract】 In recent years, genetic engineering technology develops rapidly ,but .the biosafety law could hardly match the genetic engineering technology. In our country, public are ill-informed on biosafety law and the omission, the narrow, law enforcement, inadequate oversight bodies of the law make our biosafety legislation far behind the development of genetic engineering technology. And the development of genetic engineering technology can follow nothing. Thus, the sound of our biosafety legislation in the current is necessary and urgent.This article discusses the legislative issues on the security of transgenic technology and its products. This article introduces the actuality of law on genetic engineering technology in chair, compares the laws and criterions from USA, Canada, EU and Japan. Aiming at the shortages in China’s legislation, This article provides suggestions on improvement of legislation system, in order to build a more effective law system to promote the development of genetic engineering technology in China.更多还原
