【摘要】 在知识经济时代，随着智力成果日益商品化、产业化、国际化，商业秘密成为整个国际社会日益关注和重视的问题。尽管对于商业秘密究竟是什么，人们的认识还很不一致，但都承认商业秘密是极具商业价值的无形财产，是知识产权的重要组成部分。事实上，一些重要的商业秘密往往就是一个企业的生命，比企业的资金、物资设备更为重要。在市场经济条件下，企业一旦拥有了某种重要的技术或经营诀窍，就能保持市场竞争优势，获取他人所没有的或少有的经济利益。随着市场竞争的日益激烈，侵犯商业秘密的手段花样翻新，保护商业秘密的传统方式不断面临挑战，需要进行新的探讨。在当今激烈的市场竞争环境中，探讨企业商业秘密保护的相关法律问题不仅具有现实的必要性，而且具有紧迫性。全文首先在前言部分，概括介绍了商业秘密对于经济发展的重要性，对商业秘密进行法律保护的重要意义，从而提出了本文拟研究的对象——商业秘密保护理论。随后对商业秘密进行了法律界定，不仅对商业秘密的定义进行了介绍，而且就商业秘密的范围及其构成要件进行了分析和界定，借以明确商业秘密的确定概念和界限。在明确何为商业秘密后，进一步就商业秘密的法律保护的理论基础进行了分析和探讨，重点分析了商业秘密法律保护的法理基础。同时，从司法的角度上探讨了侵犯商业秘密的行为。在此基础上，文章落脚在我国现行法律规定对商业秘密法律保护的现状上，在逐一比较分析了我国法律对商业秘密法律保护法理理论的立法现状和不足后，提出了完善措施；最后在探讨分析了我国目前商业秘密保护的立法、执法、司法现状后，提出我国应尽早制定与完善我国商业秘密保护相关立法的必要性和迫切性，以期为保护商业秘密提供有效的措施。更多还原
