工程量清单模式的合同管理研究

【摘要】 工程量清单计价是国际上普遍采用的计价方式,至今已有上百年历史。我国从2003年7月1日开始全面实施清单计价以来,目前可以说是仍处于从定额计价向清单计价的过渡期,处于在工程造价管理由传统的模式向市场模式转变时期,因而与清单计价相适应的合同管理文本及配套措施均不完善。本文分析与清单计价相适应的合同结构,对比研究国内外清单计价下的合同文本,指出国内现有合同文本的不适应性及改进建议;研究国内外清单计价下各种招投标方法优缺点和适用范围;结合运筹学理论,提出报价的线性规划及博弈平衡两阶段优化模型,并进行例证;指出国内外合同价款调整方法的不同适应条件;对比研究国内外清单计价索赔数学模型及其使用范围;运用多属性效用函数理论,探讨工程合同谈判数学模型的利用;利用模糊数学理论,对合同评判的一种模型方法进行了验证;指出在清单计价下完善相应工程担保与工程保险制度的重要性;研究合同各方存在的风险及其风险对策。

【Abstract】 Bill of Quantities, as a international assessing value method has been widely used for more than a few hundred years. From July 1, 2003, our country began to use this method. However, until now, we are still in a period of transferring from the conventional ration value to the Bill of Quantities and it also a transition period of traditional model to a market model. Under these conditions, a few of contract texts and management measures which are compatible with Bill of Quantities are not perfect.Based on analyzing contract structure of Bill of Quantities and comparing the domestic and foreign contract texts , this paper pointed out some aspects of domestic contract versions which are not adaptability to Bill of Quantities, and recommended improvement suggestion. Meanwhile, the paper studied advantages and disadvantages of the domestic and foreign bidding method of Bill of Quantities, and the scope of application. Based on operations research theory, the paper established unbalanced bid price the mathematical model and gave a example to illustrate. It pointed out different contract price adjustment conditions of domestic and international, comparatively studied domestic and international pricing claims and the use scope of mathematical models, established the project contract negotiations mathematical model by the multi -attribute utility function theory, verified a contract evaluation model by fuzzy theory. In this paper, I also pointed out the importance of project guarantee and the issuance system corresponding for Bill of Quantities, researched risk and risk measure of contract.
