【摘要】 违约精神损害赔偿是近年来一个全新提法。长久以来，我们一直固执地认为只有在侵权责任中才有精神损害赔偿，精神损害赔偿和侵权责任是连体出现的。合同责任主要是财产责任，不适用精神损害赔偿。在违约确实导致精神损害的情况下，可以通过责任竞合来实现对当事人精神损害的保护。事实是否真是如此?我们已经听到与传统理论不同的声音。用责任竞合制度来解决违约的精神损害赔偿问题存在保护空白与保护不力的缺点。笔者认为，在新的历史条件下我们应有勇气突破传统理论，探讨违约精神损害赔偿理论与实践上的可行性与必要性，让一个新的制度在新的时期发挥其应有的作用。全文对违约精神损害赔偿将从五大方面进行阐述。以第一部分相关概念阐述为基础，以第二、三部分世界各国相关立法发展及现状比较研究、我国研究现状的阐述为铺垫，以第四部分违约精神损害赔偿的必要性和可行性理论阐述为重点，最后第五部分提出了对违约精神损害赔偿制度进行构建的设想。通过文章的阐述，试图使人们对违约精神损害赔偿有全新的认识。更多还原

【Abstract】 In recent years, it has been a new subject in the civil law research , which is the compensation for moral damage in breach of contract. We have obstinately thought that only if there is tort liability, there is compensation for moral damage. The compensation for spiritual damage and tort liability appear in the same body. The traditional civil law theory thinks that the liability for breach of contract is a kind of property responsibility. So the liability for breach of contract should not include the compensation for moral damage. When there is moral damage in breach of contract, we can solve the problem by investigating tort liability. Is that an effective method? We can hear some different voice. It can not perfectly protect the aggrieved party. I think that we should break the traditional theory and research the necessity and feasibility of compensation for spiritual damage in breach of contract. It is very significant that the new theory is accepted in new era.The article is divided into five parts. The first part introduces related basic concepts. The second and third part expounds related legal regulations and development about other countries. The fourth studies the necessity and feasibility of compensation for spiritual damage in breach of contract. And at last , we discuss how to build the related system in the whole legal field. The aim of the article is making people believe that the theory is true, we should abandon the old theory and accept it.更多还原
