【摘要】 随着我国经济的稳步发展,我国建筑业呈现出良好的发展势头。但是近年来,我国建设领域拖欠工程款问题却越来越严重,拖欠工程款现象不仅严重影响了工程建设的顺利实施,破坏了社会经济秩序,恶化了社会信用环境,还导致了企业拖欠农民工工资的问题,影响了社会的稳定,己经成为阻碍我国经济发展,扰乱建筑市场的重大社会问题,到了非整治不可的程度。本课题从深入细致的调查入手,探究拖欠工程款问题的根源,并在此基础上寻求解决问题的有效方法。重点是以委托代理理论和博弈理论分析建设领域拖欠工程款问题的根源,建立解决拖欠工程款问题的有效机制。论文首先对我国建设领域拖欠工程款问题的现状、危害以及解决工程款拖欠问题的研究现状进行了深入的社会调研和分析,并简略介绍了国外预防工程款拖欠的先进经验;其次对拖欠工程款问题发生的各种原因进行了分析,并从信息经济学和博弈论的角度出发,深入分析了拖欠工程款的经济学根源,为拖欠工程款问题解决机制的建立打下了基础;针对拖欠工程款问题,文章提出了推行代建制、建立业主支付保证担保和建立业主信用评价系统的解决机制;最后根据解决机制提出了相关的配套措施,具体包括:优化代建制的管理程序和管理方法,加强信用环境建设,提高承包商风险防范意识等。并对拖欠农民工资问题提出了专门的解决办法。本课题的研究对于维护广大人民群众根本利益,规范建筑市场经济秩序,恢复建筑市场诚信,保持社会稳定,促进建筑业和国民经济健康发展都具有重要意义。更多还原

【Abstract】 Along with the development of economy in our country,the construction Industry has made much Progress. But in recent years,the question of Non-payment in construction arrears has become seriously. The phenomenon of Non-payment in construction arrears has affected seriously the process of construction,destroyed the economic order and the credit condition in society,but also led to the question of construction enterprise defaulting builder wage. The Phenomenon of construction payment influenced on the society tranquilization and has become asocial effects of pollution,so,it is the time to punish this behavior.The paper investigated deeply the reason of the Phenomenon of Non-payment in construction arrears,and tried to discover the measures to settle this question. The focal point is to set up effective settlement mechanism on the basis of Information Economic and Game Theory. Firstly, the paper investigated deeply the reason of the phenomenon of construction payment in arrears and jeopardize of its, summing up the research actuality on settle the question and collecting the overseas advanced experience. Secondly,the paper analyzed the reasons of the phenomenon, and on the basis of Information Economic and Game Theory , analyzed some correlative questions with Non-payment in construction arrears,providing the economical basis for the next analyzing. In accordance with this problem, The paper put forward some relevant settlement mechanism, such as, pursue Agent Construction System, set up Emplayer Payment Guarantee System and the Evaluating System for the Credit. In the end,the paper put forward some relevant measures as follows: perfecting the Agent Construction system,enhancing the credit environment of construction , improving the level of enterprise management and put forward special measures in accordance with labor’s wage in arrears..The research and discussion on this Problem has important meaning for maintaining the benefit of People,standardizing the order of construction market,recreating market credit and improving the construction development healthily.更多还原
